The Court of General Jurisdiction of Appeal in Tirana has acquitted 3 of the 4 perpetrators who killed Aureljo Dervishi, 18 years old, on March 31, 2024, near the roundabout in Shkoza.

The reason is that the legal process against the perpetrators has dragged on in the investigation and trial. The victim's father gave an exclusive interview to Fiks Fare, claiming that "they are killing us for the second time, my son is in the ground, those who killed him are close to the family."

This is the second time in a short time that teenage perpetrators, under the age of 18, have been released from court without being sentenced. The first case, broadcast on Fiks Fare, was in December 2024, where the perpetrators who killed 15-year-old Fatjon Bici in Gramsh were released from prison for several weeks due to delays in investigations and trials. Lawyers are demanding that such cases, with juvenile perpetrators and victims, be investigated and tried quickly.

In December 2024, Fiks Fare broadcast the appeal of the parents of 15-year-old Fatjon Bici, killed in May 2023 by several peers. The main perpetrators of the attack that took his life were suddenly released by the Court of Appeal in Tirana, after the case had dragged on in investigation and trial. A few weeks after this case, another scandal reached the editorial office of the Fiks Fare show, this time 3 of the 4 perpetrators who killed 18-year-old Aureljo Dervishi on March 31, 2024 were released.

Victim's father: He was in the wrong place and time!

On March 25, 2025, a few days before the one-year anniversary of the incident, the Court of Appeals released them on the grounds that the power of pre-trial detention had been lost. The victim's father is seeking the help of Fiks Fare to restore justice, because, as he says, "so far he has left it to the justice system, if it does not act, he will take action himself."

Azbi Dervishi says he had two children, a girl and a boy. In March 2024, his son Aureljo had just turned 18, had left his apartment in Shkozë, Tirana, and had met some friends. He says he had no conflict with anyone, not even with friends or others. "He was a worker, I used to take him to my job as an electrician. They cut off my arms," ​​says the father.

On the day of the incident, Azbiu adds that some friends called him, he went out and went to a pastry shop. There were two girls with them. When they went to the pastry shop, there were some boys there, one of whom had been having an affair. They didn't say a word and drove away. The boys followed them and stopped them at the Shkoza roundabout. They argued and then the victim's car drove away from the roundabout towards Brryli, where, after only 300 meters, the perpetrators' car passed them.

"They blocked his path and everyone came out. Then, one of the perpetrators, Shahin Hafizi, whose name I don't want to mention, pushed by the others, stabbed him. My son had no conflict with these people, nor did he know them. He was in the wrong place and time ," his father claims.

Detention terms expire, Appeal releases 3 perpetrators

The victim's father says that for many months, the court case has been ongoing in the Tirana Criminal Court. "They drag it out, sometimes one lawyer is missing and sometimes another. They have made this a fashion. Someone is always missing. Only when, on March 25, 2025, the Court of Appeals acquitted 3 of the 4 perpetrators. They also acquitted the one who stabbed him. They are 16 and 17 years old, and my son had just turned 18. They are the same age ," says Azbiu.

He further adds that they have not even summoned him to the Court of Appeal, where the security measure for 3 of the 4 perpetrators was changed. "They did not even summon us to the Appeal and nothing. I do not know how they did it, but they are now with their families and my son is in the ground. Who is responsible? They should investigate and judge quickly, it just drags on," says the victim's father, while also appealing for justice. "I have left it up to them to act until now. We, the family, should not act," he adds.

Fiks Fare has learned that on March 25, 2025, the Court of General Jurisdiction of Appeal decided to release the main perpetrator Shahin Hafizi and the two others from prison, imposing the measure of house arrest. The reason was that the pre-trial detention periods had expired, where in criminal offenses punishable by up to 10 years in prison, the period is only 6 months during the investigation and 6 months during the trial.

Procrastination releases child murderers!

Fiksi learned that the “dangerous precedent of Gramshi” has been used again by the Court of Appeal in Tirana. The case dragged on to trial and, since the pre-trial detention periods had expired, 3 of the 4 juvenile perpetrators were released.

The Fiks Fare show spoke with lawyer Eugen Beci, who said that in such cases a quick investigation and trial are needed. "In this specific case, the pre-trial detention periods have expired. If the criminal offense carries a sentence of 10 to 20 years in prison, the investigation period is 1 year. The trial period is also 1 year. In this specific case, the sentence for minors is halved and the sentence is less than 1 year. In this case, the pre-trial detention period is only 6 months during the investigation and another 6 months during the trial. A quick trial is needed, since in cases involving minors we also have the Juvenile Criminal Justice Code ," he says.

Fiksi asked the lawyer whether the legislation should be changed or there should be a quick investigation and trial. "I think there should be a quick, direct investigation and trial, let's not have such cases again! Changing the legislation is a violation of human rights ," concludes Beci.

The latest case is similar to the "precedent" of Gramshi, broadcast on Fiks Fare in December 2024. At that time, the editorial office broadcast the call of the parents of the victim, 15-year-old Fatjon Bici. The parents were worried about the court hearings, sometimes the judge did not come, other times the prosecutor. 2 of the perpetrators, one of whom is the main one, Ergi Karaj, sentenced to 27 years in prison (shortened trial 18 years), returned home under house arrest.

The victim's mother, during an interview in December 2024 for Fiksi, says that "they took her son away". "There is no state, they should be in prison, my son is in the ground, who will think about him. They are playing with my son's blood" , says Afërdita Bici. Fiksi followed the case for several days at that time and also took an interest in the Court of Appeal. A few days after the interview, the people were sentenced with a final decision and returned to their cells.
