Lawyer Kreshnik Spahiu is against changes to the Criminal Code related to the conditional release of those sentenced to life imprisonment, arguing that Albania does not have the conditions, like advanced countries, to provide the institutions and legal framework to supervise these persons.
Due to their high risk, they are predisposed to commit these serious crimes again. The lawyer emphasized that the country needs a new Criminal Code, one that is complete and not patched up.
He even suggested that Albania urgently align itself with European Union legislation, while also analyzing other changes being made, such as the punishment of journalists for revealing investigative secrets, pointing out the paradox that the media would be accused of publishing, but not judges and prosecutors who reveal the secrets themselves.
"The new Penal Code needs changes and approximation with EU legislation, it is an urgent need. This is to cope with some of the phenomena that Albania is facing today. What stands out is the proposal of the creators of this project to facilitate the life sentence of those sentenced to prison. Albania does not have the infrastructure, conditions and logistics to realize this, since life sentence convicts are those in dangerous categories", Spahiu explained to "Report TV".
Asked about the reasons why commutation of sentences for life prisoners should not be allowed, he explained:
"Because you, as a state, cannot guarantee that they will not repeat this crime, precisely because of the lack of conditions and logistics."
The lawyer also opposed the idea of increasing the age of juveniles to 20-21 years old, emphasizing that in Albania there are many young people of this age who are accused of serious crimes. And not only that, since unlike advanced countries, Albania does not even have re-education institutions to treat this category.
"It seems excessive to treat 20-21 year olds as minors. There are other countries that do, but Albania does not even have re-education institutions, it does not have the conditions to treat them. There are many 20-21 year olds who have committed serious crimes and whose sentences cannot be eased," he said.
He also criticized the situation in detention centers, where many of the arrested are held until the end of the investigative and judicial process, describing it as abnormal and where a change in the Criminal Code is needed.
"The conditions in detention are not humane, they are not normal, and detention does not mean denigration, moreover, one is presumed innocent. Albania does not provide the necessary conditions for detention and one day of detention cannot be considered one day of imprisonment," said the lawyer.
