The Special Appeals Chamber is expected to deliver justice for Judge Elbana Lluri.

At a time when the phrase “Justice Reform, Success or Failure” has occupied the front pages of the media in recent days, I had the opportunity to see that the Special Appeals Chamber had foreseen in its calendar a request for the review of the decision of former Appeals Judge Elbana Lluri. Her story has been discussed quite a bit in legal circles, as it was the only case when, for the same property, two reassessment subjects had completely opposite results from the Special Appeals Chamber. The judge in question, in a decision by a majority vote, was dismissed from office, at a time when on the same day, her ex-husband was confirmed as a judge by the same Chamber.

That the justice reform would also have controversial decisions, everyone must accept this and this conclusion is now a fact. But, the case in question, brought a lot of discussions and media, as long as both of these judges were evaluated with diametrically opposed decisions, on the same facts and evidence. Therefore, when I saw on the calendar that this panel would reconsider her request for review of the decision given, I believed that the time has come for the KPA to have the opportunity to do justice to the sad history of the decision given to this judge.

The Special Appeals Panel, headed by Ms. Ina Rama and members Mr. Sokol Çomo, Ms. Rezarta Schuetz, Ms. Natasha Mulaj and Ms. Albana Shtylla, have set the date of March 11, 2026 for the review of the decision of 06.07.2022 for Judge Elbana Lluri, according to the legislation in force which explicitly stipulates that the review of a final decision be made by the same judicial body.

This review, referred to in the law, comes after the convincing argumentation of the interested party and the objective reflection of the judging panel, on evidence and facts based on the principle of proportionality of the precedent previously followed for analogous procedural cases.

Appeals Judge Elbana Lluri, with two decades of experience in the judiciary, was qualified by the Independent Qualification Commission with a unanimous vote in her favor, both for her clean image, high professional preparation, and as regards the asset criterion, and was defeated by the Special Appeals Panel with a narrow result of three to two, at a time when her ex-husband, for the same assets, was confirmed in office.

It is expected that this time the Special Appeals Chamber will give justice to Judge Elbana Lluri, so that it will no longer be written in the future: A story with two reforms! / Pamphlet
