The Special Prosecution Office Against Corruption and Organized Crime (SPAK) has registered a criminal proceeding for abuse of office, regarding the demolition of apartments in the "5 Maji" area in 2022.
SPAK had initially requested the dismissal of the case, but the Special Court against Corruption and Organized Crime, after reviewing the documentation, found that there was sufficient evidence and officially ordered the Special Prosecution Office (SPAK) to register and launch criminal investigations into the demolition of 170 apartments in the "May 5" area, which left 222 owners homeless, some with mortgaged apartments and another part in the legalization process.
The individuals charged in this case are Prime Minister Edi Rrama, the Mayor of Tirana, Erion Veliaj, and former Deputy Mayor Arbjan Mazniku. The investigation into this case is being pursued by special prosecutor Elvin Gogaj.
This decision constitutes a strong signal for Albanian justice and a key moment for the credibility of the new justice institutions. This case will be the real test of SPAK and will show whether the Special Prosecution has the courage to go as far as the name of Prime Minister Rama, or will it simply stop at the names of Veliaj and Maznik.
If the Special Prosecution Office goes all the way to Rama, this will be the first time in history since the '90s that an incumbent Prime Minister faces a criminal investigation ordered by the Court itself for a matter that involves decision-making at the highest level of the executive branch and that directly affects the lives, property, and rights of hundreds of citizens.
What do residents want from this investigation?
The complaint requests a full criminal investigation into the entire procedure for issuing VKM No. 533, the role of state institutions, the real economic beneficiaries and their connections with public officials, as well as the individual responsibility of Edi Rama for abuse of office, violation of equality before the law, falsification of the public interest and seizure of state institutions.
The investigation focuses on the procedure for approving and implementing Council of Ministers Decision No. 533, which was used, according to citizens' complaints, as the legal basis for a one-sided, unfair and manipulated expropriation process, which has never had any real public interest, but has served to favor the multi-storey construction of private companies with close ties to local and central government.
The Prime Minister's inaction in this case, despite public denunciations and long protests by residents, is interpreted as tacit approval or direct cooperation in violating the law.
After more than five years since the launch of the project, hundreds of families from the "5 Maji" neighborhood and surrounding areas continue to be displaced, without fair compensation and without transparency over the future of their property, while constructions have been erected on their land that have no connection to community interest or public functions, but serve as projects for the sale of luxury apartments or business centers.
