The newly published report of the European Commission "Albania Screening 2023" presents its assessment of the situation in Albania after the end of the first round of Albania-EU talks regarding progress towards the standards required by membership, since the opening of negotiations in July 2022.

According to the evaluations of the European Commission (EC), Albania is presented with a moderate preparation and partial compliance of its legislation with that of the EU in some sectors and at a high level in other sectors where the implementation of the laws leaves much to be desired.

Corruption of high officials not classified as a serious crime

" Albania's legislative and institutional framework for anti-corruption is partially in line with EU legislation. Anti-corruption measures continue to have, in general, a limited impact on such vulnerable sectors as public infrastructure, cadastre, property rights, customs, taxes, public administration, education, health, public procurement and Public-Private Partnership contracts.

There have been some final punishments for high officials on corruption charges, but so far no punishment has been referred to the classification of acts of corruption as a serious crime ", it is emphasized in the EC report.

According to the report, "Albania is partially in line with the directive of the EU, the Parliament and the European Council on the fight against fraud".

" There are provisions for the sequestration and confiscation of profits derived from a criminal offense. Albania will have to fully implement the EU directive on the freezing and confiscation of instruments and products of crime, increase the coherence of the legal and institutional framework for the prevention of corruption and the integrity of public officials, especially high-level ones, recommends the EC in the aforementioned report.

The EC assesses that Albania's progress in ending impunity for high-level corruption is not decisive.

" A solid history must be achieved in the systematic fight against corruption, especially. of that at a high level, including the final confiscation of assets. Seizure and confiscation of criminal assets resulting from corruption-related offenses is still quite limited. The amounts of seized property are not reflected in the confiscated amounts. Progress has been made in the extent of confiscation procedures but without punishment under the Anti-Mafia law. The results for sequestration and confiscation abroad should also be improved ", recommends the EC to Albania.

SPAK must be strengthened and consolidated

In order to achieve this, the EC recommends strengthening and consolidating the operational and human capacities of the Special Anti-Corruption Structure (SPAK) and the Court for Corruption and Organized Crime (GJKK).

" SPAK must have a proactive approach to fight high-level corruption. Albania must ensure that SPAK has access to all relevant databases and cooperation between prosecutors, investigators and state authorities to effectively tackle corruption. SPAK needs a modern case management system and electronic data collection, which is currently done manually , "EC emphasizes.

Kadastra – pa masa efektive kundër korrupsionit

E drejta e pronës edhe pse e sanksionar në Kushtetutë për një pjesë të konsiderueshme të qytetarëve të Shqipërisë mbetet ende në letër, e parealizuar në praktikë. KE në raportimin e tij „Shqipëria -Screening 2023″ ndalet tek roli që luan korrupsioni në Kadastra në mohimin e të drejtës së pronësisë.

Situata e rënduar lidhur me të drejtën e pronës paraqitet përmes të dhënash alarmante të tilla si 7 mijë kërkesa të pashqyrtuara për kthimin e pronës tek pronarët dhe 4 mijë vendime të pazbatuara të Gjykatës Europiane për të Drejtat e Njeriut në Strasburg, ku qytetarët e Shqipërinë kanë ҫuar ҫështjet e tyre të pronës, kur gjykatat vendase me vendimet e tyre kanë shkelur të drejtën e pronësisë. Rreth 500 mijë prona figurojnë te paregjistruara dhe 80 për qind e të dhënave për pronat e regjistruara janë të pasakta.

Ka shqetësime për raportime lidhur me korrupsionin në Agjencinë Shtetërore të Kadastrës. Kjo agjenci duhet të adresojë urgjentisht korrupsionin dhe parregullsi të tjera që lidhen me regjistrimin e pronave dhe të vendosë standarde të larta të transparencës. Shqipëria duhet të sigurojë që të respektohet e drejta për një gjykim të drejtë dhe zgjidhje efektive të së drejtës së pronësisë”, thekson KE.

Trafikimit të qenieve njerëzore

KE konstaton që qytetarët e Shqipërisë trafikohen në vendet fqinje dhe shtetet anëtare të BE për shfrytëzim seksual, punë dhe kriminalitet të detyruar.

“Fëmijët e vendosur në institucione dhe fëmijët nga komuniteti rom dhe egjiptian janë veçanërisht të cenueshëm ndaj trafikimit” thekson raporti.

According to the EC, the identification of potential victims within Albanian territory or among immigrants entering the country is insufficient. The improved legislative framework for victims has not yet been implemented. The number of final convictions for human trafficking is very low and Albania needs a track record in this field, the report emphasizes.

The screening process for Albania and North Macedonia began immediately after the First Intergovernmental Conference of the European Council and the opening of membership negotiations for both countries in July of last year./ DW
