
Lawyer Kujtim Ibraj spoke about the dismissal letters for the Deputy Mayor of Tirana, Sara Goxhaj, and the Secretary General, Alban Dokushi.
According to lawyer Kujtim Ibraj, these two letters signed by the delegated mayor of Tirana, Anuela Ristani, are illegal and in violation of the Labor Code. He adds that the dismissed employees, Sara Goxhaj and Alban Dokushi, can win the case in the Administrative Court.
" Look at Article 153 of the Labor Code, which speaks of the immediate termination of financial relations. In my opinion as a lawyer, these two orders are contrary to the law and I believe that the Administrative Court will reject both, as they have no legal basis. The Labor Code has its own deadlines and provides for procedures for warning of dismissal. I believe that these two orders are contrary to the laws in force, as there is no correct interpretation and the motive for dismissal is not explained. The moment I see this letter, I think that there should be a clear motivation for dismissal ," the lawyer said on the Review show on Euronews Albania.
Lawyer Ibraj also explained the law, emphasizing that according to him, these dismissals were made using a regulation, but that they still lack a legal basis.
" It is invalid as an order. The only legal basis that these people have used is the regulation, which is the legal basis for delegation. All other actions are null and void. Also, the regulation determines the time limit, because the deputy chairman by delegation does not have the powers of the chairman, as this is not allowed. No article of Law 139 talks about the powers of the deputy chairman, but only about those of the chairman, the chairman's mandate, the end of his mandate and when he leaves office ," said lawyer Ibraj.
