SPAK has communicated the charge of abuse of office to Elvis Roshi, the former Mayor of Kavaja.

Roshi has been investigated by the Special Prosecution Office for the period he headed the Municipality, while in the last parliamentary elections, he was monitored for influence in the elections, as one of his relatives was running for MP on the open list of the coalition led by Sali Berisha's Democrats.

Roshi is being investigated for a series of tenders organized by the Municipality of Kavaja during his time as mayor. These include tenders for the city's infrastructure, including the center, as well as for decorative trees. According to SPAK, the investigation shows that the damage caused as a result of tender abuse amounts to 33 million lek.

SPAK launched investigations into Roshi in 2024, while the former Mayor has appeared several times at the Special Prosecution Office where he has been questioned by the prosecutor and BKH agents. 

The tenders for which SPAK has investigated the former Mayor of Kavaja belong to the period January 2013-December 2014.

Investigations have revealed that in at least 3 tenders, the bidder with the lowest price was unfairly disqualified as a result of incorrect bid calculation.

The investigations began after audit reports from the Albanian Supreme Audit Institution, initially from the Durrës Prosecutor's Office, and then passed on to SPAK.

How did the investigation begin?

In September 2015, Roshi was reported to the Kavaja Prosecutor's Office along with 10 other officials, as they were suspected of causing economic damage of 33 million lek in connection with tenders for the reconstruction of the city center and the construction of various roads.

These irregularities were discovered during an audit conducted by the Albanian Supreme Audit Institution for the period January 2013-December 2014, where violations were identified in 12 tenders, mainly for reconstructions, connecting roads and planting of decorative trees.

In some cases, unfair practices were found in the evaluation of bids, excluding operators with the lowest bids for unfair reasons.

The Special Prosecution Office was forced to take Roshin under investigation, following a decision by the Criminal Court.

" In the Special Court of First Instance for Corruption and Organized Crime on 30.11.2023, a criminal request was registered with no. 23/113 act, due to the declaration of lack of subject matter competence by the Court of First Instance of General Jurisdiction of Durrës, with the subject matter: "Discontinuation of criminal proceedings no. 317 of 2017, registered without an author for the criminal offense "Abuse of office", provided for by Article 248 of the Criminal Code", with the requesting party being the Prosecutor's Office at the Court of First Instance of General Jurisdiction of Durrës and the complainant being the High State Audit Office. 

At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of Judge Rudina Palloj, based on Articles 112, 75/a, 128, 128/a, 329, 329/a, 329/be et seq. of the Code of Criminal Procedure, with decision no. 23, dated 26.03.2024, decided:

1) Finding the absolute invalidity of the request of the Prosecutor's Office at the Court of First Instance of General Jurisdiction of Durrës, with the object: Discontinuation of criminal proceedings no. 317 of 2017, registered for the criminal offense of "Abuse of office" provided for by Article 248 of the Criminal Code.

2) Transfer of the acts that are with this court, forwarded by the Court of First Instance of General Jurisdiction of Durrës, for the continuation of the investigations, to the Special Prosecution Office against Corruption and Organized Crime.

3) The parties have the right to appeal this decision within 15 days from the day after the communication of the reasoned decision to the Special Court of Appeal for Corruption and Organized Crime ," the GJKKO decision stated.

Elvis Roshi was among the first politicians whose careers were cut short due to the decriminalization law.

His mandate was terminated after it was verified and proven that he had concealed or failed to declare criminal records abroad on the decriminalization form. /Pamphlet/
