The Special Prosecutor's Office has communicated the charges to 12 persons under investigation for the Tirana incinerator regarding the first measures that were set for this file in December of last year.
The investigations have been completed only for the persons who participated in the procedures up to the conclusion of the concession contract, and the communication of the charges was made because the investigative deadlines for the criminal offense for which they are accused are nearing their end.
Among the people who have been charged are Lefter Koka, Taulant Tusha, Pëllumb Abeshi, Namik Simixhiu, Bledar Karoli, Alba Thoma, Valbona Ballgjini, Sidita Kopliku, Etleva Kondi, Sidita Tola, Jetmir Llapaj and Erjon Murataj.

The Special Prosecutor's Office against Corruption and Organized Crime has completed the preliminary investigations of criminal proceedings no. 255/1 of 2020 (separate from criminal proceedings no. 255 of 2020) and submitted the request for sending for trial the defendants Lefter Koka, Pëllumb Abeshi, Erjon Murataj, Bledar Karoli, Taulant Tusha, Namik Simixhiu, Etleva Kondi, Alba Thoma, Valbona Ballgjini, Sidita Kopliku, Jetmir Llapaj, Silena Tola, accused of committing the criminal offense "Abuse of duty", carried out in collaboration, provided by articles 248 and 25 of the Criminal Code.
From the acts administered in the function of the investigation of this criminal proceeding with the object of the investigation, the concession contract no. 6597 prot, dated 31.08.2017, "Construction of landfill, incinerator and rehabilitation of existing landfills, Tirana", between the Contracting Authority Ministry of the Environment and the company "Integrated Energy BV SPV" sh.pk, with investment costs provided by the concessionaire company in the amount of 128,248,330 Euros (one hundred and twenty-eight million, two hundred and forty-eight thousand, three hundred and thirty) without VAT, illegal actions were found to have been committed due to the duties of the above persons in their capacity of the defendant, actions performed before the stage of the procedure, as well as during the procedure of granting the concession, consisting of the following:
- In relation to the proposal for granting the bonus to the proposing company "Integrated Energy BV", the members of the Concession Granting Commission, consisting of the defendants Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu , in cooperation with the former Minister of the Environment, the defendant Lefter Koka, Alba Thoma, Director of the Legal Department of the Ministry of the Environment, Bledar Karoli, Head of the Procurement Sector in the Ministry of the Environment, committed illegal actions before the stage of the procedure. , contrary to law no. 125/2103 "On concessions and public private partnership", as amended, and VKM no. 575, dated 10.07.2013, "On the approval of the rules for evaluation and awarding with concession/public private partnership", amended.
The members of the Commission have proposed granting the bonus, without drawing up a summary report, and when the proposal for granting the bonus was made, the concession granting commission had not yet clarified the costs of the project. On the part of the officials of the Contracting Authority, the Minister of the Environment, Lefter Koka, the Legal Director of the Ministry of the Environment, Alba Thoma, the Head of the Procurement Sector in the Ministry of the Environment, Bledar Karoli, a draft decision was prepared and then sent to the Council of Ministers, for awarding a bonus of 8% of the total points of the competition to the proposing company.
-Regarding the procedure for granting the concession with the object: "Construction of landfill, incinerator and rehabilitation of the landfill site in Tirana and the production of electricity", it results that the proposing company "Integrated Energy BV" (in whose composition the company is also a shareholder) of citizen Klodian Zoto, "Integrated Technology Services" sh.pk) was aware of the competitive circumstances before the procedure was announced. This happened thanks to the help given by the officials of the Ministry of Environment, Lefter Koka, former Minister of Environment, Alba Thoma, Director of the Legal Department, Bledar Karoli, Head of the Procurement Sector, as well as by the members of the awarding committee of the concession, Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, where the proposing company "Integrated Energy BV" was provided with the necessary documentation that it had to submit to the Ministry of Environment before and during the procedure concessionaire, in order to declare this company the winner.
-Në lidhje me hartimin dhe miratimin e dokumenteve standarte të koncesionit, anëtarët e komisionit të dhënies së koncesionit, Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, në bashkëpunim me titullarin e Autoritetit Kontraktor, Lefter Koka, ish Ministër i Mjedisit, kanë vepruar në kundërshtim me ligjin nr. 125/2013, “Për koncesionet dhe partneritetin publik privat”, i ndryshuar, si dhe VKM nr. 575, datë 10.07.2013, “Për miratimin e rregullave për vlerësimin dhe dhënien me koncesion, partneritet publik privat”, i ndryshuar. Dokumentet Standarte të Koncesionit nuk rezultojnë të jenë hartuar dhe miratuar nga anëtarët e komisionit, në kohën që këto dokumente janë ngarkuar në Sistemin e Prokurimit Elektronik, pasi rezulton se nga ana e komisionit nuk është mbajtur mbledhje apo procesverbal për hartimin e Dokumenteve Standarte të Koncesionit.
Rezulton se Dokumentet Standarte të Procedurës së Koncesionit janë hartuar nga punonjësit e shtetasit Klodian Zoto, pronar i shoqërisë “Integrated Technology Services” sh.p.k, pjesëmarrëse në këtë procedurë koncesioni si aksioner i shoqërisë holandeze “Integrated Energy BV”, i cili jua ka dërguar më pas punonjësve të Ministrisë së Mjedisit, të pandehurve Alba Thoma dhe Bledar Karoli. Në këtë kohë, këta dy shtetas kanë shërbyer si “urë lidhëse” ndërmjet Autoritetit Kontraktor, Ministrisë së Mjedisit dhe shoqërisë së shtetasit Klodian Zoto. Nga ana e titullarit të Autoritetit Kontraktor, ish Ministri i Mjedisit, Lefter Koka,është miratuar vazhdimi i procedurës së dhënies së koncesionit, pa patur dokumentacion shoqërues të hartimit të Dokumenteve Standarte të Koncesionit nga ana e Komisionit.
–Në lidhje me studimin e fizibilitetit, anëtarët e komisionit të dhënies së koncesionit, Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, kanë vepruar në kundërshtim me ligjin nr. 125/2013, “Për koncesionet dhe partneritetin publik privat”, si dhe në kundërshtim me VKM nr. 575, datë 10.07.2013, “Për miratimin e rregullave për vlerësimin dhe dhënien me koncesion/partneritet publik privat”, i ndryshuar, përsa i përket përllogaritjeve të kostove në studimin e fizibilitetit, duke i marrë kostot nga studimi i fizibilitetit të shoqërisë propozuese “Integrated Energy BV”, pa kryer asnjë verifikim në lidhje me vërtetësinë e tyre.
Nga aktet e administruara rezultojnë të dhëna fiktive të vendosura në studimin e fizibilitetit, të cilët kanë rritur fiktivisht tarifën e depozitimit të mbetjeve nga Njësitë e Qeverisjeve Vendore, 29 Euro/ton.
In the feasibility study prepared by the Concession Granting Commission, all the real incomes that the concessionaire company would benefit from were not taken into consideration. These revenues, which are not included, negatively affect the state budget, since if they were calculated, then the value of the fee that the Local Government Units would have to pay would be lower. The Commission for Granting the Concession did not include the income that the concessionaire company would receive from third parties for the deposit of inert waste, causing damage to the state budget. If the income that the concessionaire company would benefit from third parties had been calculated, as an income item in the feasibility study, then the part of the coverage that would be carried out by the state would have been reduced.
- From the acts administered, it appears that the employees of the National Business Center, the Register of Beneficial Owners, the defendants Jetmir Llapaj and Silena Tola, have acted in violation of Law No. 112/2020 "On the Register of Beneficial Owners", as well as VKM no. 1008, dated 24.12.2020, "On determining the manner and procedures of recording and publishing data for the beneficial owners, as well as the notification by the competent state authorities and by the obliged entities". In relation to the registration of the ultimate beneficial owners of the company "Integrated Energy BV SPV", it turns out that the accompanying justifying documentation was not submitted and administered to prove the change of the relevant shareholders for the time period in question, according to the definitions of the legal and by-laws mentioned above above.
The Special Prosecutor's Office against Corruption and Organized Crime is conducting further investigations within the framework of criminal proceedings no. 255, of 2020, for all other subjects registered within this investigation (individuals and legal entities), to evidence any other criminal fact, the actions of each of the responsible persons of the state institutions who participated before and during the concession granting procedure, as well as during the implementation of the concession contract.
