
The Judicial Appointments Council decided at today's meeting to ban the candidacy of 4 candidates for judge in the Constitutional Court, for the vacant position due to the resignation of Judge Elsa Toska.
The candidates who are prohibited from running are: Eris Hysi, Sinan Tafaj, Klodian Rado, Gentian Zyberi.
The rapporteur for this vacancy, selected through the electronic lottery on 15.01.2025, presented to the members of the KED some of the findings regarding the candidates who applied for the vacant position.
"The Judicial Appointments Council, after reviewing the acts and procedure followed for the verification of these candidacies, as well as the documentation prepared by the rapporteur regarding the fulfillment of the legal conditions for candidacy, for the candidates specified in the agenda, after also hearing the opinion of the Ombudsman, regarding the procedure followed in the verification of these candidacies, decided:
Prohibition of candidacy of candidates for judge in the Constitutional Court, for the vacant position announced on 30.09.2024 by the Assembly of the Republic of Albania, due to the resignation of judge Elsa Toska. as follows:
Eris Hysi
Sinan Tafaj
Klodian Rado
Gentian Zyberi
"The candidates for whom the ban was imposed have failed to meet one or more conditions provided for by the Constitution, the law and by-laws," the official announcement states.
The KED is continuing with the procedures for communicating decisions, for which there may also be complaints from candidates.
The Judicial Appointments Council, in accordance with the Constitution and the law, invites public institutions related to the justice system, civil society organizations with activities in the protection of human rights or created to protect the interests of users of the justice system, to present their opinions regarding the candidacies to the Judicial Appointments Council, in accordance with Law No. 115/2016 and the Law on the Constitutional Court, Article 7/b, point 2, etc.
