
The government has decided to compensate the families of the victims of the Gërdec tragedy. The decision taken today came as an obligation of a decision given by the Strasbourg Court at the end of 2023, which gave justice to those who were affected by the explosion that killed 26 people.
The court stated that the victims were deprived of the opportunity to effectively participate in the criminal trial against former defense minister Fatmir Mediu.
" Furthermore, the criminal proceedings against the former Minister of Defense for abuse of office are still pending, thus leaving the petitioners without a final decision on his responsibility even more than 14 years after the explosion ," the Court's decision states.
Among the 17 plaintiffs from Albania are the parents of 7-year-old Erison Durdajt, who together with his cousin Roxens were sending lunch to Roxens' mother who worked at the factory.
Erison Durdaj was seriously injured in the explosion and died as a result on April 3, 2008. Roxens Durdaj, then 11 years old, suffered severe burns. All 13 applicants in application no. 46707/13 and the second applicant in request no. 46714/13 (Alketa Hazizaj), were working in the facility and were seriously injured by the explosion ," the decision states.
As a result of the explosion in Gërdec, 26 people were killed and 300 others were injured. The surface of the land in Gërdec, which was under the administration of the Ministry of Defense, was made available for rent to the American company "SAC", for the process of dismantling the ammunition.
" On the other hand, SAC subcontracted the work to Albademil Ltd., a limited liability company incorporated in Albania ," states the decision of the Human Rights Court.
Therefore, the 17 plaintiffs affected by the Gërdec incident according to the ECHR have been left without a final decision regarding his responsibility more than 14 years after the explosion.
" While the Court was not taking a position on the criminal liability of FM, it considered that, given the evidence gathered against FM, the applicants as well as the general public were entitled to know not only the circumstances in which the loss of life and injuries occurred serious, but also the exact role that the former Minister of Defense had played in the events" , the court emphasizes.
The court ruled that Albania had to pay 12,000 euros jointly to Zamira Durdaj and Feruzan Durdaj and 10,000 euros each to the other complainants for non-pecuniary damage, and 8,000 euros to all complainants together for costs.
