The feats of the Rector of Medicine, Arben Gjata, continue. Two days ago " Pamphlet " published a report of the High State Control on an audit of the University of Medicine, in which many violations and irregularities were evident.
The first to break the law is Rector Arben Gjata, who is simultaneously employed as Rector and as a full-time lecturer. According to KLSH, this is physically impossible, as the question arises as to how he performs two tasks at the same time? Today we are developing this part longer, as we have focused on the appointments and dismissals he has made at the University. According to KLSH, there are lecturers who taught without a contract.
" The pedagogues contracted late by the Rectorate, are legally proven to have taught classes and to have completed the respective evaluations for the teaching hours developed, without having previously had an employment contract with the Medical University of Tirana. The external teachers, contracted by UMT, have performed the work of the teacher and at the same time have ", says KLSH.
As for the employment of Arben Djata, according to KLSH, he appears on the payroll of the Faculty of Medicine at the Department of Surgery as a full-time academic staff. Referring to the monthly summary attendance lists of the Faculty of Medicine, kept as those with no. 17/288 Prot., dated 09.01.2020, no. 371/2 Prot., dated 05.02.2020, no. 782/2 Prot., dated 03.03.2020 and continuing until this audit period, the Rector is found to be employed full-time, in the position of lecturer in the Department of Surgery of the FM of the Medical University of Tirana.
The same situation is evident for the Vice-Rectors, Mrs. AB, Mrs. SK and Mrs. Alma I. for the period 2020 and beyond. Ms. AB, turns out to be on the payrolls and attendance lists of FM in the teaching position in the Department of Laboratories with full-time teaching. Ms. SK turns out to be in the payroll and attendance lists of the FM in the position of lecturer in the Department of Pharmacy with full-time teaching and Mrs. He turns out to be on the payrolls and attendance lists of the FM in the teaching position in the Department of Internal Medicine with full-time teaching.
" The above staff are administrative staff of the Rectorate of the University of Medicine and not academic staff as it appears in the payroll and attendance lists of the FM of the University of Medicine in Tirana. At the same time that this staff appeared in the attendance lists of the Faculty of Medicine, for the entire audit period, it was established that the Rector and Vice-Rectors of the Rectorate of the University of Medicine are also in the Rectorate's attendance lists but not in the Rectorate's payroll . The attendance lists of the Rectorate, where it is clearly evidenced that the Rector and Vice-Rectors have been confirmed as full-time present in the positions in which they have been decreed or appointed, are signed (made) by the Rectorate's human resources specialist Ms. And (approved) by the Director of Legal Services and Human Resources Mr. EH ", says KLSH.
From the audit of the attendance list in the respective salary files for the Faculty of Medicine and for the administrative staff of the Rectorate of the University of Medicine of Tirana for the audited period, it was found that in the attendance lists of the Rectorate staff, they were presented as present at work with a schedule of both Rector and Vice-Rectors full time.
" There is no physical possibility for the above persons, part of the administrative staff of the Medical University of Tirana, in the management positions of public HEIs, to be present in their duties assigned by law according to the positions in their appointment, in the same time that they are engaged full-time in teaching in the relevant Departments of the Faculty. The law on higher education assigns the Rector and the Vice-Rector to perform the tasks in the function of the good administration of the UMT institution. Based on the payrolls made available to the audit group, it results that the Rector and Vice-Rector perform the duties of the pedagogue and not the duties assigned to them by law. Even according to instruction no. 29, dated 10.09.2018 of the Ministry of Education, Sports and Youth, Chapter II, point (5), "For the governing authorities of public HEIs, the annual teaching in the auditorium is": (a)- Rector 50 teaching hours, ( b)-Vice Rector 60 teaching hours, (c)-Dean 70 teaching hours, (d)-Deputy Dean 90 teaching hours and (e)- Head of Department 90 teaching hours. So teaching is allowed for certain hours and not full-time ", says KLSH.
So it turns out that the Governing Authorities of the University of Medicine in Tirana are paid for secondary functions and not for primary functions, while the law has assigned them the fulfillment of duties in the primary functions, this is also due to the importance at the national level that the University of Medicine in Albania has, which mandates a full-time management level as required by law.
" It is worth mentioning the fact that in the pay lists of the academic staff, there is no information whether this academic staff, that is, the work of the lecturer, has a primary job or a secondary job, since in these pay lists, all doctors are full-time in their commitments their academic studies in the relevant faculties ", the report states.
Regarding dismissals and job recruitments from the selective audit of the administrative personnel files of the University of Medicine of Tirana, irregularities were found in the way of following the procedures for dismissal of employees.
" Regarding the employee LL in the position "Specialist in the Procurement Sector", it was concluded that the employment contract was concluded with no. 2560/11 Prot., dated 24.10.2022, between the employee LL and the Medical University of Tirana, represented by the Administrator Mrs. SS The recruitment procedure has been followed correctly, but the procedure for terminating the employment contract has shortcomings ", says KLSH.
Specifically, in the personal file it was evidenced that on 05.01.2023, at 12:52, from the employee LK (Ll.), an e-mail was sent to the Administrator of UMT Mrs. SS, human resources office of UMT, Ms. SP with specialist duties at the Legal and Human Resources Directorate and Mrs. ND acting as Director in the Directorate of Support Services of UMT. By means of this e-mail, the employee informs the UMT about the steps followed for submitting the resignation to the institution and has also sent the resignation request as an attachment.
" It is worth emphasizing the fact that the draft order sent by the Legal and Human Resources Directorate and the order conceived and signed by the UMT Administrator for the dismissal of the employee, do not mention the fact that the employee has resigned from her job and any action of later by UMT after the resignation of the employee (which was not considered by UMT), only brings negative consequences for UMT. Nor does the e-mail sent by the Legal and Human Resources Department to the UMT Administrator state in any line that the employee has resigned with an e-mail addressed to the same Director, i.e. the Legal and Human Resources Department. As a result, even the draft order drawn up by the Legal and Human Resources Directorate had to specify the date and time of the e-mail sent for resignation by the employee and not the relationship with the violations found only by the Director of the Directorate of Support Services of UMT- moreover, these violations were not reported to the employee by UMT. In the employee's personal file, no correspondence between the employee and the UMT was found, apart from the above-mentioned correspondences ", says KLSH.
