
The number of complaints about tender abuses is increasing...
Tenders continue to be the gangrene of public administration. Both US and European Union reports emphasize that public procurement is a major risk of corruption. We all know how tender papers are sewn, but the figures also show this.
Over 1,000 tender procedures were contested last year. The data was made public by the Public Procurement Commission in its annual work report for 2024.
According to the report, during the period 1 January 2024 - 31 December 2024, a total of 1151 complaints were registered with the Public Procurement Commission, of which 1144 (99.4%) complaints were filed for public procurement procedures, 5 (0.4%) complaints for public auction procedures, 1 (0.1%) complaint in the field of defense and security and 1 (0.1%) complaint for mining permits. The total number of complaints for unique procedures appealed during 2024 is 825 (excluding 13 complaints for small purchases).
Of the 1151 (one thousand one hundred and fifty-one) complaints submitted in total, 437 of them or about 38%, are complaints submitted regarding the tender documents and 714 complaints or about 62% of them, are complaints submitted regarding the bid evaluation phase.
" In 2024, the Public Procurement Commission reviewed 1135 complaints, of which 327 complaints requested the contracting authority to make the modifications specified in the decision. During 2024, after exceeding the legal deadline, the Public Procurement Commission sent 99 requests to contracting authorities for implementation of the decision, compared to 78 requests in 2023. The average speed of implementation of the decision by the contracting authority is 6.1 days from the date of sending the request for implementation of the decision. The Public Procurement Commission has analyzed and evaluated the complaints received during 2024 in accordance with the type of contract. From the data presented, it can be seen that the highest number of complaints relates to the category of goods, where 728 or 63.2% of complaints were registered, followed by the category of services with a number of 310 or 27% of complaints, public works 112 or 9.7% complaints and mining permits 1 or 0.1% complaints ," the report states.
During 2024, the month of June has the highest number of complaints, with 124 complaints each, and the month with the lowest number of complaints is January, with 53 complaints.
It is further stated that out of 7168 unique procedures published in the Electronic Procurement System (SPE) during 2024, for public procurement with a total value of 329,947,555,156.52 Lekë, 1151 complaints were filed for 825 unique procedures appealed with a total value of 32,786,519,587 Lekë excluding VAT, for 231 Contracting Authorities, from 341 Economic Operators.
Of the 231 contracting authorities/entities, 128 are local government contracting authorities and 31 are central government contracting authorities, 2 of them are public entities, 39 of them are joint-stock companies and 31 are independent institutions.
