The investigation file of Xibraka has been re-opened by SPAK, after the request made by MP Gazmend Bardhi, based on official evidence, that the police of Elbasan and the former Serious Crimes Prosecutor's Office removed from the investigation Olsi Rama and the evidence related to the role his.
Olsi Rama filed a criminal complaint against Gazmend Bardhi on the charge of "defamation and violation of dignity", but SPAK dismissed the request, with the argument that there is no defamation; while at the same time, the re-investigation of the "Xibraka" file has started, for the concealment of evidence, with the influence of the prime minister's brother.
On May 24, 2024, deputy Gazmend Bardhi was summoned by SPAK to provide clarifications regarding the request for the re-opening of the "Xibraka" file, registered as "Case No. 88/2024".
The logic of the investigation and the Code of Criminal Procedure, forces the SPAK to start the investigation against the police and prosecution officials, who are accused of having removed the name of Olsi Rama from the file.
According to Gazmend Bardhi's accusation and the investigation that SPAK has resumed, it turns out that Neritan Nallbati, is the former Director of Elbasan Police, who removed the name of Olsi Rama and the related evidence; while the cooperating prosecutors were Olsian Çela and Edvin Kondili.
Currently, all three are in high positions, proposed and appointed by Prime Minister Edi Rama, specifically: Neritan Nallbati is the General Director of Criminal Police in the State Police.
Olsian Çela is the General Prosecutor, appointed in December 2019 with the proposal and vote of the SP; while Edvin Kondili is the SPAK prosecutor, even in December 2022 he was the candidate of Prime Minister Edi Rama, for the head of the Special Prosecutor's Office, but the USA burned his script to capture this special structure.
While these are the authors of the investigation and drafting of the "Xibraka" file, and it turns out that they left out the file of Edi Rama's brother, deliberately defining him as "Unidentified, 45 years old, tall with short hair"; but they didn't even include his trips with gang members, recorded in "Tims".
Neither the police vetting commission, did not ask chief police officer Neritan Nallbati about the forgery and fraud in the "Xibraka" file, nor did the justice vetting commission and the High Prosecution Council ask Olsian Çela and Edvin Kondil about this file, when one General Prosecutor and the other prosecutor in SPAK were appointed.
Will these three high-ranking officials of the police and justice be investigated by SPAK for the re-opened file of the "Xibraka" gang?
We recall that on the day of his appointment, the Head of SPAK, Altin Dumani, made two public oaths:
1. Will arrest anyone who violates the law, be it a high official of any function and in any state institution.
2. If he finds favoritism of the persons under investigation, he will arrest in the office every subordinate prosecutor and investigator of BKH, just like my colleagues, they should arrest me if I am going to abuse.
We do not say that the head of the police, Neritan Nallbati, the General Prosecutor, Olsian Çela and the prosecutor of SPAK, Edvin Kondili, should be arrested without proving the charges, but it is a legal obligation to investigate them as accused in the "Xibraka" file, for the removal from Olsi Rama's investigation and concealment of evidence./ Pamphlet
