For more than 10 days, the director of the company “ECO-ELB Sh.A.” in Elbasan, Leli Kaja, has been officially wanted by the District Prosecutor’s Office for a criminal case involving the abuse of public funds worth 8 million euros and intentional arson in the landfill area. However, although there is a detention order, he has not only not been detained, but has also publicly participated in the last meeting of the Elbasan Municipal Council on Wednesday.
Furthermore, during this meeting, the State Police were also present near the council premises, and did not intervene to arrest him, even though they had all the powers and an official order from the Prosecutor's Office.
The case of Director Kaja is becoming a dangerous precedent: despite his position as a person under investigation and wanted, he continues to exercise his duties, sign public tenders and represent the institution regularly. Neither the Mayor of Elbasan, Gledjan Llatja, who has the authority to appoint and dismiss him, nor the mayors of other municipalities that are shareholders in the regional company, have taken any measures to suspend or remove him from office.
According to local sources, Kaja has been considered for years as one of the current mayor's closest associates. In the past, he held important positions as Director of Water Supply and Chief Inspector of Construction in the municipality, where he was also investigated for legal violations, including unauthorized construction and mismanagement of funds.
Recent developments raise serious questions about the functioning of the rule of law and the independence of law enforcement institutions. Neither the prosecution has taken action to suspend Leli Kaja from public office, nor to transfer the file to the competence of SPAK, although the case involves high levels of abuse and the elements of organized crime.
Furthermore, Kaja continues to be the beneficiary of institutional silence for the unauthorized construction of a 2-story building with an area of over 500 m² on public property, just a few meters from the Elbasan Police building. This building has not been affected by the actions taken to free up public spaces either.
The tolerance being shown in this case leaves room for serious doubts about the political and administrative protection that the landfill director may enjoy. The situation requires immediate intervention by central institutions and specialized justice to stop a model of irresponsibility that is seriously damaging citizen trust in justice and the state./ Pamphlet
