The Academy of Sciences, led by Skender Gjinushin, has committed an institutional coup and an attempt on the rule of law, through an unprecedented and almost unbelievable act, to not recognize the constitutional bodies that constitute the foundations of the state.
The presidency of the Academy of Sciences with president Skënder Gjinushin, vice president Vasil Tolen and general secretary Shaban Sinanin, in a meeting of the last few days, have decided not to allow the High State Control to audit the activity of the Academy of Sciences.
Prapaskena learns that the decision was made with the intention of covering up illegalities within the walls of the Academy of Sciences, abusive appointments, election processes with serious violations, misuse and extortion of public funds.
The decision to close the door to KLSH was also confirmed by the member of the Academy of Sciences, Artan Fuga, in a letter to the Education and Media Commission, where he denounces flagrant violations in the elections for academics.
The illegal act declares the Academy of Sciences on an island inviolable and uncontrollable by other bodies provided for in the Constitution and laws.
Tomorrow Skënder Gjinushi and the squad of academics can also ban SPAK.

The Presidency of the Academy of Sciences initiated procedures for the admission of other academicians, which ended as a process on April 22, 2024. In itself, the addition of the assembly with new members is a happy occasion. But, he, as in other cases, is infected with irregularities, with violations of the law in force, of the Statute of the Academy of Sciences, creating inequality, privileges, differentiated treatments for the professorial body of the entire country!
The misfortune is that this illegal process is led by the presidency itself, and specifically its chairman, Mr. Skender Gjinushi, as well as the vice president Mr. Vasil Tole and General Secretary Shaban Sinani. As the president of the Academy of Sciences said, new admissions are made when the law, which he himself has conceived, has enough empty, undefined spaces, and they can be filled by voting in the assembly!!!
Votime me 98 për qind për të kaluar dhe anashkaluar, shkelur, marrë nëpër këmbë me ligje, me statute, me gjithçka që përbëjnë norma të shtetit ligjor!!! Ky është mentaliteti që drejton sot akademinë e shkencave!
Madje në mbledhjen e fundit, në emër gjoja të ruajtjes së autonomisë së kërkimit shkencor, u votua që Akademia e Shkencave të mos pranojë auditim nga ana e Kontrollit të Lartë të Shtetit për performancën e aktiviteteve të saj !!!
Shkenca në Akademinë e Shkencave me votë vendoset kështu sikurse e tregon edhe ky rast mbi institucionet kushtetuese, nuk pranon auditime, kontroll, por kryesia me votë e quan veten “mbret”, “monark absolut” e palidhur për të anashkaluar ligje, procedura dhe vetë kompetencat kushtetuese të organizmave të shtetit. Shkenca sipas këtij koncepti, akademia që mbahet me taksat e qytetarëve shqiptarë, nuk pranon të auditohet se çfarë bën, si e kryen misionin e saj. Fraza u lëshua: Për studimet tona ne nuk bëjmë auditime!
Pse këto paligjshmëri? Përse infektohen me veprime antiligjore karriera kërkuesish shkencorë, me të cilët nuk kam asgjë personale, përse drejtohet me paligjshmëri? Përse i fshihet dhe i ndruhet auditimit kryesia e akademisë së shkencave?
Mbledhja e asamblesë së akademisë së shkencave e datës 22.04.2024 ishte një “atentat” kundër shtetit ligjor, unë nuk e di në emër të kujt dhe për çfarë arsyeje! Iu tha “Jo!” Kontrollit të Lartë të Shtetit! Le ta botojnë letrën e përgatitur nga kryesia dhe që e votuan në asamble! Publiku do të lemeriset nga vendosja e vetes mbi çdo ligj dhe kontroll të ligjshëm në emër gjoja të lirisë për të qenë mbi ligjet!
Sikurse edhe e shpreha në forma të ndryshme dhe transparente gjatë punimeve të seksionit mbledhja dhe e gjithë procedura e zgjedhjeve të akademikëve të rinj (duke lënë mënjanë ato të zgjedhjes të anëtarëve të jashtëm) duke shkelur në mënyrë të ndërgjegjshme dhe të qëllimshme ligjin në fuqi për akademinë e shkencave në Republikën e Shqipërisë si edhe në kundërshtim të plotë me statutin në fuqi të asaj akademie. Ato procedura shkelin me të dy këmbët edhe Kushtetutën duke mos respektuar barazinë në të drejta të qytetarëve dhe duke privilegjuar në mënyrë të jashtëligjshme persona të veçantë brenda asaj asambleje.
Sikurse theksova edhe gjatë mbledhjes në fjalën time vetë koncepti “promovim karriere” për të kaluar në mënyrë të jashtëligjshme persona të veçantë nga statusi i akademikut të asociuar në atë të akademikut është i pambështetur në asnjë nen apo fjalë të ligjit dhe në asnjë nen të statutit. Kjo bën që e gjithë procedura e mbështetur në këtë koncept manipulues dhe antiligjor të dali nga kuadri i normave juridike në fuqi në Republikën e Shqipërisë, të cilat janë shumë të qarta dhe të përcaktuara.
On this basis, the self-appointed technical commission to review the candidates' files has seriously and purposely neglected its duty and has hidden deficiencies that are of a serious and essential nature for that procedure. There is no decision of the assembly to open the places for academics, the section according to the Statute and the law in force for opening these places has not been consulted, HEIs have not been notified, the candidates' files lack support from two academics, there is no expertise on the achievements of candidates from the basic units where the candidates are attached, nor support from HEI senates.
On the other hand, the candidacy, instead of being individual, has become collective by several candidates together. The candidates were not even heard as required by the Statute and other serious legal and statutory violations were also manifested.
All these constitute a violation of the law and points 3, 4, 5, 6, 7, 8 of Article 7 of the statute.
On the other hand, despite repeated requests from my side, the specific criteria related to the analysis and evaluation of the candidates' achievements according to the law and the Statute were ignored.
The latter requires that candidates:
- have successfully led a number of doctorates,
- have directed research and scientific centers or units,
- have directed scientific research groups,
- have participated in organizing committees or headed boards of international scientific journals ,
- as well as having scientific works published abroad,
- or scientific articles in journals with impact factors or indexed in qualitative databases (at least first or second authors as required by the law on higher education and scientific research ).
But the leadership of the academy of sciences does not ask about them! Vote and bypass any law!
I emphasize that all these violations of the law and the statute seriously compromise the process of voting for academics and their result, as well as the evolution as academics of the presented candidates or even of the external members of the assembly. They re-repeat the mentality shown over and over again that with the force of the vote the law and statute in force are violated, placing responsibility on the leadership of the academy of sciences and all the persons who are tasked with leading the above processes.
I urge candidates not to accept an academic career tainted by legal and statutory violations.
I, as a member of the academy of sciences, distance myself from these illegal practices initiated by the leadership of the academy of sciences and reaffirm before the public and the community of researchers and scientific researchers, the country's universities, that I have neither agreed nor do I ever agree with them, even if I am alone. Experience has taught me that even a single vote can be the bearer of truth.
