Nicolas Sarkozy's stay in La Sade prison will be decided this Monday. A Paris court will decide whether to release the former French president, less than three weeks after he began serving a five-year prison sentence for the Gaddafi Libya financing scandal.
Sarkozy was acquitted of all other charges, including corruption and receiving illegal campaign financing. The former president will not be present in the courtroom, but will participate via videoconference from a room set up inside his detention center.
The law gives courts two months to consider requests for release. For the former president, that will be done within 20 days. Sarkozy became the first former French head of state in modern times to be sent to prison after his conviction on September 25.
Prosecutors accused Sarkozy of illegally accepting money from then-Libyan leader Gaddafi for his 2007 presidential campaign.
