A federal grand jury in the US state of Virginia has indicted former FBI Director James Comey on two charges related to his testimony before Congress.
Comey, who has long been criticized by US President Donald Trump, is accused of lying to Congress during his testimony in September 2020 regarding whether he had authorized the leak of classified information to the media.
Responding to the indictment, Comey declared himself innocent and said he had "great faith in the federal judicial system."
The lawsuit comes days after Trump called on the nation's top law enforcement official, Attorney General Pam Bondi, to more aggressively investigate his political opponents, including Comey.
The investigation is being led by Lindsey Halligan, the U.S. Attorney for the Eastern District of Virginia, who was previously Trump's personal attorney.
The court hearing against Comey, where the charges are formally read to a defendant in court, is scheduled for the morning of October 9 in Alexandria, Virginia at 10:00 a.m. local time, CBS reports.
US Attorney General Pam Bondi said in a statement that the indictment "reflects the Department of Justice's commitment to holding accountable those who abuse positions of power to defraud the American people."
Comey has been indicted on one count of making false statements and another of obstructing justice.
The Justice Department asked the grand jury to consider three charges against Comey, but it could agree that only two of them were supported by sufficient evidence to be tried in court.
The third charge was for making false statements.
A grand jury is a group of citizens assembled by a prosecutor to determine whether there is sufficient evidence to bring charges. In legal terms, it determines whether there is probable cause to believe that a crime has been committed.
Comey is the first former FBI director to be charged with a crime, and he maintains that he did not lie under oath.
If found guilty, he could face up to 5 years in prison.
A lawyer for Mr Comey, Patrick Fitzgerald, issued a statement noting that his client denied the allegations, adding: "We look forward to exonerating him in the courtroom."
Comey said in a video statement that "my family and I have known for years that there are costs to standing up to Donald Trump."

Mr. Comey served as FBI director between 2013 and 2017.
He had a tumultuous tenure that included overseeing the high-profile investigation into Democratic candidate Hillary Clinton's email just weeks before the 2016 election, which she lost to Trump.
He was fired by Trump amid an investigation into Russian interference in the 2016 election.
This is not the first investigation into the former FBI chief to begin this year.
He was investigated by the Secret Service after sharing and then deleting a social media post of seashells spelling out the numbers "8647," which Republicans claimed was an incitement to violence against U.S. President Donald Trump.
The number 86 is a slang term whose definitions include “to reject” or “to get rid of,” according to the Merriam-Webster dictionary, which also notes that it has recently been used as a term meaning “to kill.” And Trump is the 47th president of the U.S.
In July, Mr. Comey's daughter, Maureen Comey, was fired from her role as a federal prosecutor in the Southern District of New York. According to media reports, she was given no reason for her dismissal from the office where she had worked for 10 years.
Earlier this month, she sued the Trump administration over her firing.
