A Southern California man was accused of shooting and killing a homeless man and caught the entire scene on video, according to the Orange County District Attorney.
The victim was sleeping on the sidewalk when he was killed by the perpetrator. Police identified the elderly man, Craig Sumner Elliott, 68, as the killer. Elliot was jogging the afternoon of Sept. 28 with his two dogs in Garden Grove, Calif., when he saw Antonio García Avalos, 40, sleeping in the middle of a sidewalk, the district attorney's office said in a release.
Elliott, who had a wheelchair with him, used the wheelchair to push Avalos in an attempt to wake him up. The sleeping man woke up and started yelling at Elliot to get away from him, the release said.
The elderly man, who was charged with manslaughter and personal use of a firearm, according to CNN.
The district attorney's office said Elliott had an active permit from the Orange County Sheriff's Department for the use of the weapon. Authorities said in the release that a video posted by Elliot shows Avalos standing up and throwing a shoe at Elliot.
Seconds later, Elliot shot Avalos three times, who later died of his injuries, according to the release.
The Garden Grove Police Department arrested Elliott on a warrant on Nov. 17, and he was released after posting $100,000 bond on Nov. 20. Elliot is scheduled to appear in court on Dec. 15. He faces a maximum sentence of 21 years in state prison, according to the district attorney.
