The charges being examined relate to the formation and operation of a criminal organization, the murder of Pavlos Fyssas, as well as the murderous attack against Egyptian fishermen.

The prosecution requested full confirmation of the indictment in the second instance at the Five-Member Criminal Court of Appeal. The prosecution requested the guilt of all 42 defendants in the Golden Dawn trial, exactly as it had been decided in the first instance.

The charges under review relate to the formation and operation of a criminal organization, the murder of Pavlos Fyssas, as well as the murderous attack against Egyptian fishermen. The prosecution proceeded with a broad and individualized analysis of the role of each former Golden Dawn MP, using public statements, specific actions and actual incidents, while at the same time deconstructing the defense allegations presented by the defendants.

The prosecution specifically mentioned the organization's leader, Nikos Michaloliakos, emphasizing that he was the absolute and undisputed leader of Golden Dawn, with full knowledge and control of what was happening within it.

As noted, Michaloliakos constantly and unhesitatingly proclaimed his Nazi ideology, while his words presented a double face, as they varied depending on the audience, attributing his positions to subsequent misinterpretations.

At the same time, he emphasized that the organization sought, through violence, to replace the state, even going so far as to control the legal documents of foreigners, while not hesitating to threaten institutional political figures, such as the then mayor of Athens, Giorgos Kaminis.

The prosecution stressed that the defendants, and especially Michaloliakos, failed to take into account the fact that Democracy, which actually showed him leniency in his younger years, "may be imperfect, fragile and complex, but remains superior precisely because it offers the possibility of correcting its mistakes."
