A new legal development is shaking up the case of the murder of Charlie Kirk, the founder of Turning Point USA and a prominent conservative activist who was killed on September 10, 2025, on the campus of Utah Valley University. According to legal documents obtained by TMZ, the defense of Tyler Robinson, the 22-year-old accused of the crime, claims that the bullet found during the autopsy does not match the rifle associated with the suspect. This remains to be proven, but if the defense confirms the claim, it would constitute a significant development in the case.

"I can't match the bullet to the rifle"

Robinson is charged with aggravated murder and six other charges; if convicted, he faces the death penalty. The defense has filed a motion highlighting a significant discrepancy in the ballistics evidence: the ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives) summary report shows that experts were unable to identify the bullet from the rifle suspected of being linked to Robinson.

“ATF was unable to match the bullet found during the autopsy to the rifle suspected of being associated with Mr. Robinson,” the defense motion states. Attorneys say this could be exculpatory evidence and have announced the possibility of calling the ATF analyst to testify at the preliminary hearing.

The defense also points out that some forensic analyses remain incomplete. It is considering having the material analyzed by independent experts to verify its reliability. So far, the prosecution has submitted a large volume of evidence to the defense: some 61,500 pages of documents, 31 hours of audio and over 700 hours of video divided into more than 5,000 clips. According to the lawyers, at least 60 days are needed for a full initial review.

Robinson's arrest

Robinson turned himself in to authorities on September 11, 2025, at the Washington County Sheriff's Office at approximately 10 p.m. According to previous reports, he confessed to the act to his father, who then shared it with a youth pastor who had contact with the U.S. Marshals.

Among the incriminating evidence initially presented were DNA and fingerprints found at the crime scene, as well as a forearm print from the position from which the shooting was suspected. However, the latest ATF report casts doubt on the direct connection between the gun and the deadly bullet. The rifle in question is described as an older model Mauser, modified for modern calibers.

Foreign track

As InsideOver reported in October, FBI Director Kash Patel blocked the investigation of Joe Kent, then head of the National Counterterrorism Center and close to Tulsi Gabbard, who resigned in recent weeks, into possible foreign involvement in the killing of Charlie Kirk. According to the New York Times, Patel believed Kent was interfering with the FBI’s official investigation, while the FBI was reviewing files for evidence of foreign assistance to suspect Tyler Robinson. Kent’s colleagues, on the other hand, say he was simply following up on possible leads to rule out any connection to foreign or domestic actors.

The New York Times does not mention a specific suspected country, while previous reports from InsideOver and The Grayzone have raised the issue of tense relations between Kirk and Israeli Prime Minister Benjamin Netanyahu, suggesting a complicated political background.
