The "National Association of Media and Justice" sets the Constitutional Court on fire: The point that "automatically" paved the way for the 7 members of the KPA to appeal is unconstitutional.  

A decisive battle for the rule of law in Albania has officially begun, as the first lawsuit has arrived at the Constitutional Court that openly opposes the "invasion" of the justice system by the 7 members of the Special Appeals Chamber (SAC), whose mandate expires in June 2026.

At the center of the legal storm is a single, but explosive point: Point no. 6, of article 166 of the law on the “Status of Judges and Prosecutors”, which according to the association “National Association of Media and Justice” is completely incompatible with the Constitution of Albania. This association has filed a voluminous material requesting the repeal of this point, and the reason is simple: the Constitution of Albania, in article 136/a, clearly states that only citizens who are appointed by the High Judicial Council after completing the School of Magistrates and after completing the process of preliminary verification of their assets and character can be judges.

Now, the question is: how many of the 7 members of the KPA have completed Magistrates' School? None!

And this is precisely where the crux of the scandal lies, because the "Status" law allows those who, just because they have been part of the Vetting, to automatically move to the Court of Appeals, as if they are above the law.

The lawsuit has also made public the names of the 7 members who seek to infiltrate the system: Sokol Çomo, Albana Shtylla, Natasha Mulaj, Rezarta Schuetz, Mimoza Tasi, Ina Rama and Ardian Hajdari.

Sources from the High Judicial Council indicate that for years these members have not only lobbied this council, but have openly requested that vacant positions in the Tirana Court of Appeal be reserved for them, with the sole aim that after the end of their mandate in the KPA, they can begin work as judges without any competition.

This is no longer a transition, this is an official reservation of seats before the competition opens, a kind of "social apartment" for Vetting officials with state money and in violation of the Constitution.

While the association was filing the lawsuit, the High Judicial Council sent the Assembly an official request for the personal files of the 7 members, and a lobbying visit by KPA officials to the Supreme Judicial Council has raised suspicions that the process is being politically rushed, attempting to "concrete" their passage before the Constitutional Court has the final say.

The debate that the Constitutional Court will examine is fundamental: if the status of "constitutional judge" that the members of the KPA have is only related to the temporary function of Vetting, then after June 2026 they are simply ordinary citizens and must compete like everyone else, attend the Magistrate's School and be verified.

But if the Court upholds point no. 6, then it would legitimize a massive circumvention of the Constitution, creating a new class of “elite” judges appointed not on the basis of merit and law, but on the basis of a political mandate. This is not just a judicial process; this is the greatest test of constitutional integrity in post-reform Albania.

If the 7 members of the KPA enter the Judiciary through this short path, then the entire Vetting process risks turning into a "carousel" that revolves around the same people, mocking the School of Magistrates and hundreds of other lawyers who have been waiting for years for the right to compete.

The "National Association of Media and Justice" has placed a stone on the shoulders of the Constitutional Court. Now the answer is awaited: will the Constitution prevail, or will the politics of chairs triumph? / Pamphlet

Le qe kujt do ti vij turp Ilir Rusit qe gjate gjithe karrierres se tij juridike ka qene inferior ndaj ketyre te"mencurve" ne drejtesi, qe ska bere gje tjeter vetem qe i ka mbajtur canten Kudret Celes dhe Skender Kacupit? Turp te behen gjyqtare Mimoza Tasi, Natasha Mulaj, qe i marrin te keqen juristeve te "Plepave" qe etiketojne komunistet si Albana Shtylla, Sokol Como, Ina Rama, Rezarta Shulz. Ti fusin ne site per pasurite e tyre sic futen te gjithe gjyqtaret dhe prokuroret dhe te shohin sa ju vlen lekura. Albana Shtylla eshte me shtepi ne Dhermi, ndersa nje gjyqtareje i kerkonte llogari dhe nuk ja besonte pronat e trasheguara nga te paret e saj. Zoti vonon por nuk harron keni per te pare. E drejta zhytet por nuk mbytet.
