SPAK has completed the investigations for the 7 accused in the "Metamorfoza" file and handed it over to the GJKKO for trial. Behar Bajri, Astmer Bilali, Edmond Preka, Ardid Hasanbegaj are 4 of the accused.
Among the defendants in the case are the businessman Pëllumb Gjoka, the former chief of Operations, Oltion Bistri, and the former head of the Kukës Prosecutor's Office, Xhevahir Lita.
The lawyers of the businessman Pëllumb Gjoka have objected in all sessions to the acceptance of Sky Ecc communications as evidence, for which they have appealed to the Constitutional Court.
The Constitutional Court will consider it on November 19 at 10.00.
During the preliminary examination, Bistri Gjoka and Lita have also requested a shortened trial, a decision for which the court will express in the first session of the trial on the merits.
The decision was taken by judge Elsa Ulliri, while the case was passed for trial without debate by the parties.
1. The defendant Pëllumb Gjoka, accused of committing criminal offenses:
"Premeditated murder", to the detriment of the victim Gjin Ndoj (Boriçi), finalized on 09.08.2020, in the city of Shkodra, carried out in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by structured criminal groups and criminal organizations", provided by articles 78/2, 28/4, 333/a/1 and 334, of the Criminal Code.
"Providing the conditions and material means to commit murder", to the detriment of the citizen Kleant Musabelliu, carried out in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by the group structured criminal and criminal organization", provided by articles 80, 28/4, 333/a/1 and 334, of the Criminal Code.
"Providing the conditions and material means to commit murder", to the detriment of citizens Dorian Duli and Ibrahim Lici, carried out in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of crimes criminal by structured criminal group and criminal organization", provided by articles 80, 28/4, 333/a/2 and 334, of the Criminal Code.
"Active corruption of the judge, prosecutor and other justice officials", carried out in cooperation, provided by articles 319 and 25, of the Criminal Code.
"Illegal possession and production of weapons, explosive weapons and ammunition", carried out in the special form of cooperation, that of a structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by a structured criminal group and criminal organization ”, provided by articles 278/1, 28/4, 333/a and 334, of the Criminal Code.
2. The defendant Behar Brajović, accused of committing criminal offenses:

4. The defendant Astmer Bilali, accused of committing criminal offenses:
“Sigurimi i kushteve dhe i mjeteve materiale për të kryer vrasje”, në dëm të shtetasve Dorian Duli dhe Ibrahim Lici, kryer në formën e veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal, “Grupi i strukturuar kriminal” dhe “Kryerja e veprave penale nga grupi i strukturuar kriminal dhe organizata kriminale”, parashikuara nga nenet 80, 28/4, 333/a/2 e 334, të Kodit Penal.
5. I pandehuri Ardrit Hasanbegaj, i akuzuar për kryerjen e veprave penale :
“Sigurimi i kushteve dhe i mjeteve materiale për të kryer vrasje”, në dëm të shtetasve Dorian Duli dhe Ibrahim Lici, kryer në formën e veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal, “Grupi i strukturuar kriminal” dhe “Kryerja e veprave penale nga grupi i strukturuar kriminal dhe organizata kriminale”, parashikuara nga nenet 80, 28/4, 333/a/2 e 334, të Kodit Penal.
6. I pandehuri Oltion Bistri, i akuzuar për kryerjen e veprave penale :
“Korrupsioni pasiv i personave që ushtrojnë funksione publike”, “Zbulimi i akteve ose të dhënave sekrete” dhe “Pastrimi i produkteve të veprës penale ose veprimtarisë kriminale”, parashikuar nga nenet 259, 295/a dhe 287/2, të Kodit Penal.
7. I pandehuri Xhevahir Lita, i akuzuar për kryerjen e veprave penale :
“Korrupsioni pasiv i gjyqtarëve, prokurorëve dhe funksionarëve të tjerë të drejtësisë”, e kryer 2 (dy herë), dhe “Zbulimi i akteve ose të dhënave sekrete”, parashikuar nga nenet 319/ç dhe 295/a, paragrafi 2, të Kodit Penal.
Në kuadër të hetimeve të këtij procedimi penal, janë sekuestruar si produkt i veprës penale, ndër të tjera, disa pasuri të paluajtshme, të cilat i janë bashkëngjitur akteve të dërguara për gjykim si më poshtë:
1.3 (tre) pasuri të paluajtshme të llojit “Pyll”, me sipërfaqe totale prej 390 000 m2, si më poshtë :
1.1. Pasuria e llojit Pyll, me sipërfaqe 113.500 m2, e ndodhur në Pulaj-Plazh, Velipojë, Shkodër;
1.2. Pasuria e llojit Pyll, me sipërfaqe 61.470 m2, e ndodhur në Pulaj- Plazh, Velipojë, Shkodër;
1.3. Pasuria e llojit Pyll, me sipërfaqe 215.030 m2, e ndodhur në Pulaj-Plazh,Velipojë, Shkodër;
2. 5 (pesë) pasuri të paluajtshme të llojit ndërtesa, me vlerë blerje sipas kontratave 980 300 Euro, si më poshtë :

Meanwhile, for the other persons under investigation, accomplices in the commission of the above criminal offenses, for whom the security measures approved by the Special Court of First Instance for Corruption and Organized Crime have not yet been executed, for other criminal facts , as well as for other persons involved in criminal activities, which resulted during the investigative actions carried out in this criminal proceeding, the division of the criminal case was decided and continue are still in the stage of preliminary investigations.
