
The Court of Fier acquitted Fatmir Hoxha, who was accused of murdering 50-year-old Ahmet Toska in the "Sheq i Madh" neighborhood.
Hoxha won his freedom after the retrial of the case by the Court of Fier and a re-examination of the evidence such as footage from security cameras, clothing, etc., which disproved the accusations of his authorship.
According to the Court, there is no convincing evidence that the murder was committed by him.
Fatmir Hoxha was arrested on November 14 at the Rinas airport, returning from Italy, where he had traveled with his wife, while according to the lawyer's claims, he was returning to clarify the charges against him.
Ahmet Toska was executed on October 26 at 06:00 in the morning while the victim was accompanying his wife to work.
A masked person approached him and shot him in the head with a bullet.
Film footage and traces of gunpowder on clothing were the evidence of the Prosecution, with which the security measure was taken to arrest Fatmir Hoxha, accused of the execution of Ahmet Toska in front of his wife on October 26, 2020 in Fier. The 52-year-old, while addressing the cell, declared to reporters that he was innocent.
This was the reaction of Fatmir Hoxha, after the Court of Fier decided to keep him in prison for the execution of 50-year-old Ahmet Toska in front of his wife.
The 52-year-old denied the accusation in the session with closed doors in front of judge Alfred Konomi.
As his strongest contradictory evidence, he is quoted as having used the fact that he woke up that morning at 08:00, while the crime in the village of Sheq i Madh was recorded two hours earlier.
But the judge did not take into account the claims of Fatmir Hoxha and his designated lawyer, mainly trusting the evidence presented by the Prosecutor's Office, which has film footage and gunpowder stains on the clothes in the file.
"In our opinion, there was no evidence to formulate a "reasonable suspicion", for us there was no reasonable suspicion and therefore we asked for a milder arrest measure than the house arrest measure", said the lawyer of Fatmir Hoxha.
According to sources, the weapon of the crime has not yet been found, as the motive of the crime remains unclear, although there is a suspicion that it is related to intimate matters.
