While the employees of ASHK Shkodër are accused of having enabled the legalization of several buildings built without permission in the same area, where due to the special status and protection, the legalization of informal buildings is prohibited by law.
The defendants are the citizens with the initials AD, BL, EB, FT, I.SH., SS and BK, with the duties of specialists and responsible for the legalization sector at the Shkoder ASHK.

The Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Shkodër sends to trial 9 officials and former officials of the Territory Protection Inspectorate (IMT) and the State Cadastre Agency for committing the criminal offense of 'Abuse of duty' in collaboration, provided by articles 248 and 25 of the Criminal Code.
The employees of IMT Shkodër Municipality are accused of having allowed the illegal construction of a two-storey building in the area of Shiroka, Shkodër, by their actions and inactions in violation of the law, by not recording and reporting it to the prosecutor's office, even though it is proven that they had knowledge. While the employees of ASHK Shkodër are accused of having enabled the legalization of several buildings built without permission in the same area, where due to the special status and protection, the legalization of informal buildings is prohibited by law.
More specifically, it turned out that the citizen AD, after ascertaining the illegal construction of a two-story building in the area of Shiroka, Shkodër, which was being built by the citizen SK, on a surface of land claimed to be owned by the complainant's family, reported to the prosecution the fact that the employees of the IMT Shkodër Municipality had not taken measures to prevent the construction even though they had been repeatedly notified by it.
From the investigations carried out within the framework of the criminal proceedings no. 1179/2021, it was found that the citizens EK and MH, inspectors at the IMT Shkodër Municipality, even though they had been notified of the illegal construction and were tasked with verifying the complainant's complaints, after they went to the field, they did not record this fact in a record of findings, reporting that no new construction was found, at a time when the investigation by the judicial police proved the construction of this new building . In fact, for the illegal construction of this building, its builder, a SK citizen, was sentenced by a final decision.
Meanwhile, after the investigation related to the legalization of the informal building built by the SK citizen, as well as after deepening the investigations for 9 other cases of legalization of informal buildings in the area of Shiroka, Shkodër, it was found that the procedure of their legalization is carried out in violation of the law, since the area where the relevant facilities are located is protected with a special status as a managed natural reserve, and as a result, their legalization has been prohibited. In connection with the illegal legalization of these informal facilities, the citizens AD, BL, EB, FT, I.SH., SS and BK, with the duties of specialists and responsible for the legalization sector at ASHK Shkoder, were taken as defendants at the time of completion of the respective procedures.
