Prime Minister Edi Rama returns to the legalization of cannabis. Although the law has been approved for over a year, it has not been implemented. But today at the government meeting, it seems that the discussion has returned and it is likely that the granting of licenses will begin very soon.

The government has approved the decision " On the procedure and way of using the revenues of the National Cannabis Control Agency ".

According to this decision: The revenue from the license issuance fee for applicant entities is 100% transferred to the state budget; 70% of the income from the annual fee on the activity of the licensed entities is poured into the state budget and 30% is used by the Agency; The revenues of the Agency, created according to point 2, of this decision, are classified in the budget structure with chapter 06 "Own revenues beyond the limit" non-inheritable and are used only for investments and expenses of the operational activity of the Agency .

According to the government, the Ministry of Health and Social Protection and the National Cannabis Control Agency are charged with the implementation of this decision.

The decision comes at a time when the government will have to approve the budget for 2025 and we are in an election year. Next year we have the solutions and apparently Rama needs money.

Details of the law

The law was approved in July last year. There are provided all the conditions for the aspects of granting licenses and permits to the interested subjects. Next to the National Agency for the Control of Cannabis, the Commission of Licenses will be set up, which will administer and verify the requests submitted by the entities. This commission will also impose sanctions on those entities that are provided with permits and licenses but that violate the conditions or go beyond the defined legal framework.

There is a limitation in the law regarding the maximum area of ​​land that can be cultivated with cannabis. Specifically, the total area allowed for the cultivation of the cannabis plant for medical purposes cannot be greater than 200 hectares nationally. Also, the area of ​​the activity license unit for medical purposes cannot be smaller than 5 hectares and not larger than 10 hectares. This restriction is expected to spark a fierce battle between companies to be licensed.

The license is granted for a period of 15 years. The applicant, in order to be provided with a license, pays at the time of submission of the application a fee which is non-refundable. The amount of the fee, the procedure and the way of using this fee are determined by the decision of the Council of Ministers. Every 3 years, the conditions of the license are re-evaluated by the Agency, which, if it finds non-fulfillment of the conditions and criteria, proposes, as the case may be, the suspension or cancellation of the license or requires the subject to fulfill the conditions within a 30-day period. No later than 6 months before the end of the validity period of the license, the entity may request its renewal when it proves that it meets the conditions of the licensed device, according to the provisions of this law. / Pamphlet
