The head of the parliamentary group of the Democratic Party, Gazment Bardhi, seems to have sided with Sali Berisha.
He told "News 24" that the Assembly follows two standards in the case of Sali Berisha's decision. Unlike Saimir Tahiri where, according to Bardhi, SPAK sent a request to the Assembly for the same security measures, no such procedure was followed for Berisha.
" The obligation to appear and the obligation not to leave Albania are coercive measures of deprivation of liberty according to the interpretation that the Parliament of Albania itself has made in the past. In October 2017, in the case of MP Saimir Tahiri, he considered them as coercive measures of deprivation of liberty. A different standard cannot be applied. That standard of the Assembly has been certified at all levels of the judiciary.
In the case of Mr. Berisha, this standard is applied differently and added then the procedure followed by SPAK is "sui generis", meaning that it never happened. The law states that a request must be submitted accompanied by a relation and evidence supporting the charge. The Assembly removes the immunity in any case. It must prove whether the charge is political or not and the law has decided to require evidence. Replacement of security measures is not done by the Assembly. The duty and responsibility of the Assembly is to analyze whether the accusation leveled against a deputy is based or political, and for this the law has decided to bring the evidence.
I withdrew the file because I am a member of the Council of Mandates and there was a request and 4 court decisions. According to the Constitution, I am forbidden to analyze and comment on the decisions of the Court because there is no relationship between the Assembly and the Court, there is a relationship between the Assembly and the Prosecutor's Office. This has nothing to do with Sali Berisha, I will keep this position just in case.
