The battle between Edi Rama and Erion Veliaj has moved to the Constitutional Court.
The public hearing for the mayor's dismissal is on October 31st, and after the Presidency, the government has sent the written arguments today. But what is striking is that Edi Rama is "hiding behind his finger."
Even though it was Rama himself who instructed and even pressured the members of the municipal council to vote for Veliaj's dismissal, the argument put forward by the government is that "the government implemented the council's decision."
" There can be no doubt about the concern of the municipal councilors for the serious damage caused to the needs of the capital's governance and the interests of the citizens of Tirana by the prolonged absence from duty of the Mayor. The Municipal Council has proposed dismissal, as the only legally possible way in its hands, in order to initiate further procedures to restore normal governance in the Municipality of Tirana. This political and legal will of the elected representatives of the Capital cannot be neglected and the Council of Ministers has no other alternative but to finalize the legal dismissal procedure ," the government emphasizes.
The government also continues to follow the same line as the President. According to it, the dismissal was not made according to Article 115 of the Constitution: “ The challenge of the decision in the Constitutional Court cannot suspend its effects, because the Constitutional Court is not competent for dismissal for reasons other than those determined by point 1, Article 115, of the Constitution and letter “a”, of Article 62, of Law No. 139/2015, and the filing of the appeal in the Constitutional Court, in the wrong body for reviewing legal remedies for the appeal, does not bring legal effects. Likewise, the filing of the appeal in the competent administrative court does not automatically suspend the legal effects of the act ”.
With the signature of the Secretary General of the Prime Minister's Office, Engjëll Agaçi, the Council of Ministers has submitted to the Constitutional Court all the written documentation on the basis of which the dismissal of the mayor was decided.
