
The representative of the Socialist Party in the Central Election Commission, Elena Duka Xhina, in an interview with Report TV, commented on the recent developments regarding the Democratic Party's complaints to the KAS and the debate about the legal impossibility of candidates to complain separately.
Asked if the DP also joined forces with the SP to oust its candidates, Xhina emphasized that "it is a matter of law enforcement and not political desires," explaining that the Electoral Code is clear when it says that complaints can only be made by electoral entities, not by individuals.
"Regardless of the desire that the DP may have to support its candidates, it is impossible from a legal point of view. KAS must first implement the law, then discussions can take place," she said.
On the other hand, Duka emphasized that the only way for candidates is to appeal to the Electoral College, but even this, according to her, is not expected to change anything.
"KAS must first implement the law and then there are political views. I believe that they should appeal to the Electoral College, which is the second level of appeal, but I believe that it will be the same conclusion since it is a legal determination and no one can go beyond the law." - said the legal representative of the SP
Duka said that the sessions at the KAS have turned into a marathon, as "all 12 districts have been appealed by the DP", while only one appeal has come from the "Mundësia" party, and another from Albania Becomes.
"The complaints are almost all from the DP, today is the fourth day that we have been holding marathon sessions, where all 12 districts have been complained about by the DP. We have had only one complaint in this period of time, from the Opportunity Party, and from Albania Is Done, while all the other complaints are from the DP," continued Xhina.
Regarding the claims about the diaspora vote, the SP representative emphasized that the DP is constantly bringing the same evidence, without any new elements or facts to prove invalidity.
"We have no case for a citizen to say 'I didn't vote and it turns out I did vote'. The DP did not bring a complaint that went to them themselves, but took it to the DHL point. No one has shown any invalidity for this", declared Duka, adding that he has followed the process closely and is well aware of all the issues raised", said Xhina.
