Democratic Party MP and Chairwoman of the Media and Human Rights Committee, Jorida Tabaku, participated in the international conference organized on the occasion of the 30th anniversary of membership in the Council of Europe and the 35th anniversary of the establishment of the Venice Commission.
Speaking at the panel dedicated to constitutional justice, Tabaku emphasized the importance of the balance between political will and legal control, calling this "the fundamental pillar of every modern democracy."
"In every modern state, the Constitution is the highest legal act, and on this foundation a delicate balance is established between the political will of the majority and the legal control of the Constitution. Parliament is the expression of the sovereignty of the people; the Constitutional Court is the guarantee that this sovereignty is exercised within the limits of law and justice," said Tabaku.
She thanked the Venice Commission for its irreplaceable role in protecting democracy and institutional balances in Albania over the past decades, describing it as "the most valuable partner of Albanian democracy."
In her speech, Tabaku also focused on the consequences of the three-year absence of the Constitutional Court in Albania, describing this period as a crisis of constitutional democracy.
"The judicial reform, although launched with good intentions and with a significant contribution from the Democratic Party, left the country for three years without a Constitutional Court. At that time, Albania was a state without a constitutional arbiter. Every initiative that affected the balance of power remained without the test of constitutionality. And it seems that the majority got used to it without it."
The opposition MP recalled that the Venice Commission has described this situation as "unprecedented in the history of constitutional justice," while adding that the absence of the Constitutional Court damaged not only internal order, but also the European integration process.
"When a country agrees to live without a Constitutional Court, it risks living without democracy. A state without a Constitutional Court is like a clock without a compass; it can move temporarily, but in the wrong direction."
Finally, Tabaku emphasized that protecting constitutional balances and the independence of institutions are essential for Albania's European future, calling on institutions to stay above the politics of the day and protect the spirit of the Constitution.
