Constitutional Court delays decision on Balluk, Judges' Meeting postponed

The Constitutional Court continues to suspend its decision regarding the "Balluku" case.

The government has filed a complaint with the court, requesting the overturning of the security measures by the GJKKO, claiming that it has violated the Constitution and has taken over the powers of the Prime Minister, the President, and the Assembly.

But the Constitutional Court seems to be dragging out the process, once again postponing the decision on whether to accept the Prime Minister's appeal or not. It was announced a little while ago that the Judges' Meeting has been postponed to December 12th.

This is the third postponement. The Prime Minister's appeal was made on November 21. The file was transferred to the College of Judges, which initially met on Thursday of last week, but the meeting was postponed to December 2. Yesterday, the College did not have unanimity and the file was transferred to the Meeting of Judges, which will decide on the fate of the file whether it will be reviewed or not in a plenary session.

The meeting was expected to be held tomorrow, but the Constitutional Court announces that it has been postponed to December 12. The CC states that this has happened due to the complexity of the case, the volume of accompanying materials and the Court's agenda, as well as based on the request of some of its members.

In the request sent to the Constitutional Court, the Council of Ministers states that the decision of the Special Court to suspend the Deputy Prime Minister and the Minister of Infrastructure and Energy directly interferes with the competencies of 3 state bodies: the Prime Minister, the President, and the Assembly.

" The suspension brings serious consequences for the state and social interest by creating an institutional vacuum as it prevents the proposal of projects of national importance for integration into the European Union, around 800 projects to be approved by the end of 2027 by the ministry led by the minister, who has been suspended through the decision of the GJKKO ," the Council of Ministers reasons. According to the government, Belinda Balluku could not be suspended from office, since in her capacity as a member of the government she enjoys the rights of a deputy.

The government in its arguments refers to Article 103 of the Constitution, which expressly states:

1. Anyone who has the qualifications for a deputy may be appointed as a Minister.

2. The Minister may not exercise any other state activity nor be a director or member of the bodies of for-profit companies.

3. Members of the Council of Ministers enjoy parliamentary immunity.

This postponement is also a "blow" to the prime minister, who a little earlier reacted on social media by stating that the government's work is being damaged with each passing day.
