Lawyer Jordan Daci debated with analyst Denis Dyrnjaja about the DP's $6 million lobbying contract in the US. Lawyer Daci said that there is nothing illegal and the only thing is that the law on political parties prohibits the financing of parties by foreign entities and this cannot be verified except through an investigation.
Meanwhile, Dyrnaja said that Albanian parties have given $4.5 million for lobbying in the US, with the largest being that of the SMI, for which former President Ilir Meta has also been accused.
The debate
Jordan Daci: Normally it is a contract that has been known since Roman times, one person contracts with another person and a third party benefits. There is nothing illegal. The only thing, with the information I have, the law on political parties prohibits the financing of parties by foreign entities. It is clear and this cannot be verified except through investigation.
In this specific case, SPAK will not find a criminal offense outright, but it is its functional duty to verify.
Then, whether we are dealing with foreign financing or not, here, if we draw conclusions, there will be problems.
The contract must be executed. Today there are only a few promises, the parties can withdraw.
However, a second problem, if it is to be called financing, of course here it is up to the DP to make the appropriate assessments and to send the declaration of the expenses they will make. It is about 250 thousand dollars per month, it must be subject to declaration if it is considered a benefit. In my opinion, it must be declared to the CEC.
Those persons must be identified, the donors, must have Albanian citizenship in addition to American citizenship, because they are considered foreigners.
Dyrnjaja: If you look at it in the block, the obligation for every donor is in the US, not in Albania, because the service is done there and the money is there. Here we are in the context of morality. In the US, it is an obligation.
Jordan Daci : The law when prohibiting funding says that it is diverse and the DP must justify the benefit it is receiving.
Denis Dyrnjaja : Is the DP the beneficiary, or Mr. Berisha?
Jordan Daci: I start from the content of the contract, and then they will decide for themselves who the ultimate beneficiary is.
Denis Dyrnjaja: The whole incident is in the USA.
Jordan Daci: Yes, but it also has effects in Albania.
Denis Dyrnjaja: It could also have an effect in Cyprus.
Jordan Daci: The benefit remains in Albania.
Denis Dyrnjaja: It is implied.
Jordan Daci : No, it is not implied.
Denis Dyrnaja: 4.5 million dollars were given by parties from Albania that lobbied in the US, among them the SMI is the largest entity and the largest amount is 700 thousand dollars, which is also under investigation by Ilir Meta.
Jordan Daci : The law on political parties prohibits anonymous donations, they must be made in a special account opened by the political party. Otherwise, they must be declared.
Are we dealing with foreign funding or not? Institutions should monitor it.
Second, there is undoubtedly a question here that needs to be clarified whether there is funding during the campaign, or whether it is not included. The timing coincided with the campaign. If I were the DP, I would declare it, there is nothing wrong with it. SPAK does not ask permission from anyone to carry out verifications. /TPZ/
