This Constitutional Court decision can be used as a precedent by Berisha to invalidate the current 'compulsory appearance' measure by SPAK.

The Constitutional Court has ruled on Sali Berisha's request regarding the three lower courts' positions on the measure of house arrest, ruling in favor of the former Prime Minister that the duration of his house arrest was excessive.

Based on the sources of Top Channel journalist Anila Hoxha, the decision was given at the end of the session without the presence of the parties.

The issue is related to the position of Berisha's lawyers who, during the two-month reporting or information, opposed SPAK's position insisting that Berisha should continue to remain under house arrest, which as a result turned into an obligation to appear in January 2025.

This Constitutional Court decision can be used as a precedent by Berisha to invalidate the current 'compulsory appearance' measure by SPAK.

Sali Berisha has been charged with passive corruption in the privatization process of the properties of the former "Partizani" sports complex.

According to SPAK, he is suspected of using his position as prime minister to influence legal and administrative decisions, with the aim of the process benefiting his family members, including his son-in-law, Jamarbër Malltezi.
