
The government's lawsuit goes to the Judges' Meeting...
The Constitutional Court College has accepted Prime Minister Rama's lawsuit regarding the "Balluku" case, passing the matter to the Judges' Meeting.
Following the decision of the Constitutional Court to suspend the Deputy Prime Minister from office, there was an appeal to the Constitutional Court by the government, where the Prime Minister claims that the court's decision is unconstitutional, as it has interfered with his powers.
The court initially convened on Thursday of last week, but the meeting of the College was postponed until today. After discussions, the lawsuit was accepted and there will be a review at the Meeting of Judges, where it will be decided to proceed to the session and whether the government's second request, that of suspending the decision of the GJKKO until a final decision is made by this court, will be accepted.
In the request sent to the Constitutional Court, the Council of Ministers states that the decision of the Special Court to suspend the Deputy Prime Minister and the Minister of Infrastructure and Energy directly interferes with the competencies of 3 state bodies: the Prime Minister, the President, and the Assembly.
" The suspension brings serious consequences for the state and social interest by creating an institutional vacuum as it prevents the proposal of projects of national importance for integration into the European Union, around 800 projects to be approved by the end of 2027 by the ministry led by the minister, who has been suspended through the decision of the GJKKO ," the Council of Ministers reasons.
According to the government, Belinda Balluku could not be suspended from office, as in her capacity as a member of the government she enjoys the rights of an MP.
The government in its arguments refers to Article 103 of the Constitution, which expressly states:
1. Anyone who has the qualifications for a deputy may be appointed as a Minister.
2. The Minister may not exercise any other state activity nor be a director or member of the bodies of for-profit companies.
