Prime Minister Edi Rama declared at the meeting of the socialist parliamentary group that the independence of SPAK and GJKKO will not be violated, while in parallel, extensive changes are being prepared in criminal legislation and in the functioning of the justice system.
He emphasized that the majority will intervene in criminal policy, criminal procedures, alternative sentencing, and the separation between criminal and administrative cases.
Rama also placed the presumption of innocence at the center, considering it damaged in practice.
"All of us here will keep the baby in mind very carefully before throwing out the dirty water, which we will throw out because the justice reform is a strategic investment of the Socialist Party of Albania, for an irreversible historical change in the full sense of the word such as the independence of justice and every discussion, reflection or decision of ours as legislators that we possess, not by chance. They say that when the people choose, the people feel and it is what the people feel that pushes the result in certain directions that sometimes surprise all those who look at things from above and not from below as the common man sees them.
We, as the possessors of this qualified majority in relation to the justice system, must be guided by this great truth and must serve only this great truth. Independent justice is the greatest investment of the Socialist Party for all generations to come. Not a step back.
The independence of the judiciary is not affected, it is only strengthened.
SPAK is not affected, it is only supported. Steps forward, yes, without any discussion.
Criminal policy, criminal procedures, legal guarantees for civil servants, alternative punishments, the redrawing of the boundaries between criminal and administrative cases that have become like those white visas that have only a name, but not a birthmark, and of course, first and foremost, the erection of the collapsed pedestal of the presumption of innocence, not only as a universal principle of freedom and human rights in a democratic order, but also as a social necessity for a country like ours that has emerged from a dehumanizing trauma like that of the dictatorship of prosecutors and judges during the communist era, the consequences of which still play their role today and in today's institutional life of the country, are our issues first and foremost. They are our responsibility!
Those 58% of Albanians and Albanians who are in prison without trial are our issue and our responsibility. That terrifying number that puts Albania, the penultimate country, half a step ahead of Russia in terms of the ratio between convictions and acquittals, is our issue, it is our responsibility and no one can take these away from us. We cannot delegate these to anyone and for these we must answer to everyone first and foremost.
It is a self-imposed topic on our agenda. That is why we have engaged first with the Ministries of Justice of Italy and France. They have made available to us a network of the best experts they have in the field of criminal policy and criminal proceedings with the Council of Europe, which has also made available to us its own experts to draft a document of amendments regarding criminal proceedings, which we will of course also consult with the European Commission.
"Even the new draft of the Criminal Code, a colossal work of a group of independent experts under the leadership of the director of the Magistrates' School, Professor Arben Rakipi, after the group reflected on a stream of remarks drawn from the public consultation, we have shared it with those I mentioned, with the support of these trowels as well as the government of the Netherlands, which has generously provided us with a very experienced expert," said Rama.
