Tomorrow's session at the Mandates Council to lift Belinda Balluku's immunity is expected to be held behind closed doors.
According to "EuronewsAlbania", Prosecutor Dritan Prençi has asked the Parliament not to open the plenary session to the media, as there are secrets that could compromise the investigation. The session will be held tomorrow at 10:00 and we are expected to see what the deputies will decide. Meanwhile, the new head of SPAK, Klodian Braho, is also expected to be present at the session.
At the request of SPAK, the GJKKO decided a few days ago to suspend Balluk from her duties as minister and deputy prime minister. This caused a strong reaction from the prime minister, as according to him, the GJKKO has taken on powers that do not belong to her.
The government argues that the minister has immunity as a member of parliament and cannot be suspended. The case went to the Constitutional Court and last week the latter accepted Rama's request, while suspending the GJKKO decision until a final decision is made. However, SPAK seems to have taken it as a challenge and has now made another request, requesting the lifting of Balluk's immunity in order to allow a coercive measure against her.
SPAK's request to the Parliament
The Special Prosecution Office against Corruption and Organized Crime, based on Articles 73, 95 and 103 of the Constitution of the Republic of Albania, Article 288 of the Code of Criminal Procedure, as well as Articles 13 and 118 of the Regulation of the Assembly of the Republic of Albania, within the framework of criminal proceedings no. 136 of 2025, has submitted a request for authorization from the Assembly of the Republic of Albania for the arrest/deprivation of liberty of the deputy/minister/deputy prime minister:
Belinda Balluku, born and residing in Tirana, who exercises the functions of MP, minister and Deputy Prime Minister of the Republic of Albania.
This citizen has been taken as a defendant in criminal proceedings no. 136 of 2025, as she is accused of committing the following criminal offense:
"Violation of equality of participants in tenders or public auctions", committed in collaboration, provided for by articles 258/2 and 25 of the Criminal Code, in relation to the procurement procedure with the object "Construction of the Llogara tunnel".
Also, citizen Belinda Balluku has been placed under investigation on suspicion of committing the same criminal offense for seven other procurement procedures with the following objectives:
“Completion, reconciliation and continuation of the works on Shqiponja Square-Tirana River, Lot 1 and QMT”;
“Construction of the road segment Sheshi Shqiponja-Bulevardi i Ri, Lot 2”;
“Construction of the road segment Sheshi Shqiponja-Bulevardi i Ri-Shkozë, Bridges over the Tirana River”;
“Construction of the Tirana Outer Ring Road, Lot 4”;
“Construction of the Tirana Outer Ring Road, Lot 5”;
“Construction of the Tirana Outer Ring Road, Lot 6”;
"Construction of the Tirana Outer Ring Road, Lot 7".
This request aims to obtain authorization from the Assembly for further legal proceedings.
