Tabaku also stated that the law of strategic investments is totally non-transparent in its implementation, while he described it as abusive and extremely clientelistic.
The deputy also mentioned the violation of the right to property, saying that it is also mentioned in the progress report.
"I had some comments about your law Mr. Shalsi, it is a law that I have been following for a long time. I believe there are some concerns that are worthwhile. First of all, I'm sorry that the government's response to your law was "we don't make any changes, we don't make any improvements, we only asked for the deadline to be postponed" and the postponement of the deadline for the fifth time is extremely disturbing. You said that the investment law is being drafted, in fact the new investment law has been being drafted for 10 years. We are in 2014 when this law was introduced and it was said that an integral law for investments is being drafted and we are in 2024 and an integral law for investments is still being worked on.
I do not believe that in the 35-year history of the transition, there is a process of drafting a law than this investment law. Secondly, after I have carefully analyzed, at least that information that is public, because I have expressed many times the concern that the law of strategic investments is totally non-transparent in its implementation; I noticed that out of 84 requests where more than 40 are accepted, 44 if I'm not mistaken, 75% are for tourist villages.
Today AITA has not yet given us an assessment of how these strategic investments have affected the economy, secondly what employment they have brought, thirdly how they have affected the stock of foreign investments, how many foreign investments have come to the country because this was exactly the main goal. of this law, the bringing of foreign investments that actually did not happen and the fact that 75% of them are located and are realized in the field of tourism for me is enough fact to say that the law is absolutely abusive and extremely clientelistic.
So Mr. Shalsi, when I say next time that there are laws that are considered state capture laws, don't be fooled because it has nothing to do with you, it has to do with the government and the majority and it has to do with the fact that this is one of those laws exactly.
Second, having said that, I have a real concern about property, as far as all strategic investments go, a concern and you didn't accommodate it with requirements because you were focused on the decision-making process, the property acquisition concern is a concern. which today has created the biggest problem in the implementation of the law.
I also mentioned in the last meeting, in the cadastre of Vlora and in all the cities of the south, the main problem of corruption is related precisely to the implementation of this law, because the law takes into account that properties which are the property of legitimate owners, mediate between two private individuals to I sold these at a non-market price, but a VKM price.
Violation of the right to property is also mentioned in the progress report, it is mentioned in several progress reports in a row as the law of strategic investments, the problems in its implementation and at the same time it is also mentioned with the law of protected areas that unfortunately passed a few weeks ago in the Parliament. You had mentioned some changes in the process. For example, I did not agree at all with Article 13 that you had proposed, where you said that Article 13 should be completely removed, the document application procedure should be completely restructured, and for me it was a meaningless change and there were also some changes that were to be evaluated and it is unfortunate that they are not being taken into account. For example, you had thought that there should be more representatives, but the Ministry, with the fear it already has of the implementation of the law and the fear it has of the law, said "no, I don't want any space to participate in the decision-making process".
The conduct of competition in this field is for me the main key that is missing in every sphere in fact, but this law of strategic investments is missing in a special way. I am against the postponement of this deadline, against these laws that are actually made to order for 14 investments that have not yet been granted and will be granted, and I am against it because I see it as related to the law of protected areas. But above all I am against and in relation to the article which violates with both feet the right of the legitimate owners, which has become a reason for abuse in all the cadastre offices, especially in the south of the country.
I understand that there may be other colleagues who are concerned about this, there may be other colleagues who see it the same way and I hope that there is support across the political spectrum because it has nothing to do with politics because it is not neither the left nor the right law is a law for the market, it is a corrupt and clientelistic law in my opinion because this is how its implementation has turned out.
So congratulating you, Mr. Shalsi, because I congratulate every colleague who undertakes legal initiatives, even hoping that my laws will have the same fate as yours, that they will be reviewed with priority, because it will take me 1 year for them to be reviewed in the commissions of others not in the Economy Committee because the Economy Committee has been very fair with all colleagues who have proposed laws. I hope that we say no to this practice brought about by the spirit of the law of strategic investments.
