The Electoral College accepts the DP's claim and asks the Appeals and Sanctions Commission to examine it.
The Democratic Party wants to be represented in the elections of September 24 in Kukës by two members in KZAZ and not one decided by KQZ, but KAS did not accept the lawsuit.
For this reason, he appealed to the Electoral College, which with its decision brings "Repeal of Decision No. 179, dated 22.08.2023, of the Commission of Appeals and Sanctions 'Regarding the non-acceptance for review of appeal request No. 93, dated 20.08.2023 , filed by the "Democratic Party of Albania".
Likewise, the College decided that the Appeals and Sanctions Commission must take a final decision regarding the appeal request No. 93, dated 20.08.2023, filed by the "Democratic Party of Albania", within 2 days from the notification of the reasoned decision.
DECISION
Today, on 01.09.2023, at 09:00, the panel of the Judicial Electoral College, composed of judges:

in the court session held in the premises of the Administrative Court of Appeal, at the address: Rr. "Ismail Qemali", Tirana, after examining case No. 37 Basic Reg., Date 29.08.2023 Registration, with:
PLAINTIFF: Democratic Party of Albania, represented by Mr. Indrit Sefa.
RESPONDENT: Central Election Commission - CEC, represented by Mrs. Ina Osmanaj and Mr. Erion Meta.
INTERESTED PERSON: Freedom Party, represented by Mr. Altin Kaziaj.
OBJECT: Repeal of decision no. 179, dated 22.08.2023, of KAS "Regarding the non-acceptance for review of appeal request no. 93, dated 20.08.2023, filed by the "Democratic Party of Albania".
Obligation of the Appeals and Sanctions Commission (KAS) to take a decision, regarding appeal request no. 93, Dt. 20.08.2023, filed by the subject "Democratic Party of Albania".
LEGAL BASIS: Articles 21, 64, 65 and 66, 124, 124/1, 145 et seq. of the Electoral Code;
Nenet 1 dhe 2 të Udhëzimit nr. 01, datë 23.12.2020 të Komisionerit Shtetëror të Zgjedhjeve “Për përcaktimin e rregullave për depozitimin e verifikimin e dokumentacionit të kandidimit, afatet për publikimin e listave të kandidatëve dhe miratimin e modeleve të kandidimit”.
Për dijeni, Komisioni i Ankimimeve dhe Sanksioneve, me Vendim nr.179, datë 22.08.2023, objekt i kërkesë-padisë së mësipërme, ka vendosur:
“Mospranimin për shqyrtim të kërkesës ankimore nr. 93, datë 20.08.2023, të paraqitur nga “Partia Demokratike e Shqipërisë”.
Ky vendim hyn në fuqi menjëherë dhe publikohet në faqen zyrtare të Komisionit Qendror të Zgjedhjeve.
Bazuar në pikën 1 të nenit 145 të Kodit Zgjedhor, kundër këtij vendimi mund të bëhet ankim në Kolegjin Zgjedhor Gjyqësor pranë Gjykatës Administrative të Apelit, brenda 5 ditëve nga shpallja e tij, sipas përcaktimit të pikës 2 të nenit 152 të Kodit Zgjedhor”.
me Vendimin Nr. 34, datë 01.09.2023, Kolegji Zgjedhor Gjyqësor, me shumicë votash,
VENDOSI:
1. Pranimin e padisë.
2. Shfuqizimin e Vendimit Nr.179, datë 22.08.2023, të Komisionit të Ankimimeve dhe Sanksioneve “Për mospranimin për shqyrtim të kërkesës ankimore Nr.93, datë 20.08.2023, të depozituar nga “Partia Demokratike e Shqipërisë”.
3. Detyrimin e Komisionit të Ankimimeve dhe Sanksioneve të marrë vendim përfundimtar në lidhje me kërkesën ankimore Nr.93, datë 20.08.2023, të depozituar nga “Partia Demokratike e Shqipërisë”, brenda 2 ditëve nga njoftimi i vendimit të arsyetuar.
4. Court costs are charged to the defendant.
5. This decision is final and no appeal is allowed.
6. It was announced in Tirana on 01.09.2023.
