Why has Albulena Haxhiu become an obstacle to the Goga-Bajrami case, what scares the minister?
An illegal director is at the head of the Institute of Forensic Medicine of Kosovo (IML). The mandate of Ditor Haliti, acting in this institute, expired three months ago, while he still continues to lead without any new decision that allows him to exercise his duties.
Haliti was appointed on December 8, 2022, for a one-year term in this position by the Ministry of Justice (MOJ), and his mandate expired on December 8, 2023.
Whereas, Flutura Goga was chosen as the director of this institute with the regular competition announced by the Ministry of Education, to whom this ministry is still not giving the mandate that belongs to her by law, on the other hand, the decision to appoint her director according to the competition regular is also in force.
The voice of Goga-Bajrami for her right is not being heard by the MD. On the contrary, Minister Albulena Haxhiu has become an obstacle to Goga-Bajrami from appointing him to the position by delaying the implementation of legal decisions.
Goga-Bajrami has addressed all the competent instances instead of establishing her right to exercise the duty that she won after a regular competition and for which she was notified by the Ministry of Health on December 6, 2022 that she will start work on December 7 of the same year, the decision that Goga-Bajrami is appointed director of IML is published on the official website of this ministry. This ministry cannot legally cancel the competition, but it is delaying to give the task to Goga-Bajrami, harming him in terms of material and career advancement.
Goga-Bajrami has addressed the Minister Albulena Haxhiu, from whom he has requested that an act of appointment be issued on her election as the general director of the IML.
"If you do not make a decision, I am obliged to claim my right on this issue in all other forms determined by the laws in force. Also, for the non-implementation of this decision, I will be forced to notify all the relevant local and international institutions operating in the Republic of Kosovo for the non-implementation of the decisions by the executive, namely the MD", says the letter sent to Haxhi, provided by Pamphlet.
Goga also emphasizes that it is being damaged in terms of material damage and career advancement. After the groundless answers from the Ministry of Internal Affairs, specifically from the general secretary of the Ministry of Justice and the silence of the Minister of Justice, she turned to the Division for Human Resources of the IML, from where it was suggested that she send the complaint to the Labor Inspectorate. (IP). Flutura Goga-Bajrami submits a complaint to the Labor Inspectorate, alleging non-implementation of the decision by the employer, the Ministry of Justice, which has been selected in the external competition, announced by the MoD for the position of general director at the Institute of Forensic Medicine from the MoD.
But, the Labor Inspectorate in their response to the complaint of Mrs. Goga have said that they have no legal responsibility to deal with this issue, suggesting Goga to address the Competent Basic Court in Pristina as a complaining party. "The labor inspectorate does not have the competence to deal with legal relations, which are regulated by other laws. The complaining party is instructed to send the same claims to the competent body, to the Competent Basic Court", says the IP's letter dated February 6, 2024, which the Pamphlet possesses. Goga-Bajrami has also turned to the People's Advocate to resolve her case.
The pamphlet has also been addressed to the Ministry of Justice regarding this case and has not received any response. Also, the newspaper contacted the head of the IML, Ditor Haliti, on the basis of which decision he is continuing his work, and from him he only received this short answer "for all these questions you should contact the cabinet of the minister of justice". .
Meanwhile, Flutura Goga-Bajrami told Pamphlet that she will pursue all legal avenues to achieve her right, which is being denied by the Ministry of Justice with baseless reasons. She says that the damage caused to her by the MD is very big, and not only material according to her but also in her career. Goga-Bajrami said that she has repeatedly encountered the ignoring of her requests to the MD. "I am waiting for an answer from the people's advocate and to start with other procedures that my law guarantees to protect my right".
