The Supreme Court of Kosovo has rejected as illegal the appeal of the ruling party, Lévizja Vetëvendosje (LVV), against the certification of the largest party of Serbs in Kosovo, Lista Serbe, paving the way for its participation in the 9th parliamentary elections. February.
"The panel of the Supreme Court, in the session held on December 30, 2024, rejected as impermissible the complaint of the political entity Vetëvendosje, submitted against the decision of the Panel for Complaints and Submissions (PZAP)", he told Radio Free Europe Antigona Uka-Lutfiu, spokesperson of this court.
This decision comes after last week, the ruling party appealed to the Supreme Court against the decision of the Electoral Panel for Complaints and Submissions (PZAP) to order the Central Electoral Commission (CEC) to certify the Serbian List for participation in the February 9 elections.
The CEC is now expected to meet to certify the Serbian List - which enjoys the support of official Belgrade - and give it the green light to participate in the February 9 elections.
Representatives of the ruling party in the CEC had voted against the certification of the Serbian List in a meeting held on December 23.
Two days later, PZAP accepted the complaint of the Serbian List, overturning the decision of the CEC, and ordered it to certify the Serbian List, saying that this party had submitted the documentation in accordance with the Law on general elections and with other CEC rules.
The representatives of the ruling party have justified the opposition to the certification of the Serbian List by saying that this party does not recognize the state of Kosovo and continues to call it the autonomous province of Serbia, "Kosovo and Metohija".
The decision of the PZAP was welcomed by the Serbian List, which described the CEC's decision as an attempt "to eliminate the Serbian List" from the electoral process.
All this, according to this subject, was done to "favor the Serbs who are in agreement with [Kosovo Prime Minister Albin] Kurti since everything was carried out directly under his orders and was politically motivated."
Those familiar with political developments have told Radio Free Europe that the non-certification of the Serbian List by the CEC was part of the pre-election campaign.
Even the West had expressed concern and regret for the non-certification of the Serbian List after the decision of the CEC on December 23.
Lista Serbe decided to participate in the February 9 elections after a period of boycotting political processes in Kosovo.
