The President of Kosovo, Vjosa Osmani, announced that she has addressed the Constitutional Court to seek clarification if the Kosovo Assembly is not constituted by July 26, the deadline previously set by the court through a judgment.
"Our request today, in essence, is a request for clarification of the legal consequences of not constituting the Assembly within the constitutional deadline of 30 days ," Osmani said at a press conference.
"Every mandatory constitutional deadline and every failure to comply should have legal consequences, but they were not clarified in the preliminary ruling. Our request today is essentially a request for clarification of the legal consequences of not constituting the assembly within 30 days ," she said.
According to Osmani, the goal is to clarify the situation regarding the failure to constitute the Assembly within the 30-day deadline and to clarify how the powers of each constitutional institution are exercised, in the absence of
the constitution of one of the main pillars of the principle of separation of powers,
which is the Assembly.
Also, " it should be clarified what happens if the Assembly is constituted after July 26 ," she said.
Osmani said that in the request sent to the Constitutional Court, which concerns the resolution of the conflict of competences, he also submitted a temporary measure to suspend the Constitutional Court's 30-day deadline.
"The request for a temporary measure is an opportunity to avoid putting the institutions in an endless blockade, and entering a situation where the institutions could be constituted in an unconstitutional manner and would be untimely ," said the head of state.
The Constitutional Court of Kosovo has obliged MPs to constitute the legislative body by July 26. On July 21, MPs failed for the 50th time to constitute the Assembly of Kosovo, as parties that were in opposition last term are opposing the change in the voting method for the speaker of parliament from open to closed.
The Democratic Party of Kosovo and the Alliance for the Future of Kosovo have described the LVV's nominee for speaker of parliament, Albulena Haxhiu, as a divisive figure. Meanwhile, the Democratic League of Kosovo has said that it will not vote for any candidate nominated by the LVV for speaker of parliament.
The leader of the Vetëvendosje Movement, also the acting Prime Minister of Kosovo, Albin Kurti, said that his party is willing to co-govern with Fatmir Limaj's Social Democratic Initiative, to which party he said he has made a concrete offer.
The leader of LVV, the winning party in the February elections, said he hopes that talks with Limaj's party will be finalized this week.
"This weekend we will have news about the agreement reached or the lack thereof ," he said.
In the 120-seat Kosovo Assembly, 61 votes are needed to successfully vote on the new speaker. The Vetëvendosje Movement, as the winner of the most votes in the February 9 elections, has 48 seats in the Assembly, followed by the Democratic Party of Kosovo with 24, the Democratic League of Kosovo with 20, the Serbian List - the largest Serb party in Kosovo with 9, and the coalition between the Alliance for the Future of Kosovo and the Social Democratic Initiative, with 8. Another 11 seats are held by minorities.
The Social Democratic Initiative alone has three MPs in the Assembly. In addition to Limaj, this party is represented by Xhevahire Izmaku and Arbëreshë Kryeziu.
The acting Minister of Administration and Local Government and the chairman of the new Democratic Initiative of Kosovo (IRDK), Elbert Krasniqi, has previously signaled that seven non-Serb minority MPs would vote in favor of the constitution of the new Assembly and a new government led by the Vetëvendosje Movement.
In a scenario where the Vetëvendosje Movement, Nisma MPs, and seven minority MPs were to vote for the constitution of the Assembly, three more votes would be needed to successfully finalize the process.
So far, minority MPs, Duda Balje, Veton Berisha and Adem Hoxha have stated that they will not offer support without their conditions being met./ REL
