The Electoral Complaints and Appeals Panel (ECAP) has decided to certify the Serbian List for the early parliamentary elections on December 28.

In a decision published on December 5, the ECAP said that the Central Election Commission had not provided “any justification” for rejecting the recommendation to certify the Serbian List for participation in the elections.

"... The recommendation of the Office for Certification and Financial Control at the CEC, dated December 2, is accepted, certifying the political entity Serbian List for participation in the early elections," the decision published on December 5 said.

According to the ECAP, the CEC's decision is " deficient, incomplete and does not address the crucial issues and facts related to the assessment of the legal conditions for the certification of the political entity" .

The panel said that the Serbian List has met the legal requirements for participation in the elections. At its meeting on December 2, the recommendation to certify the Serbian List, the main Serb party in Kosovo that enjoys the support of Belgrade, received only two votes in favor, two against, and seven members abstained.

The Vetëvendosje Movement members on the CEC, Sami Kurteshi and Alban Krasniqi, were the only ones to vote against. Kurteshi said during the meeting that “I have always said that this party works against the interests of Kosovo.” The decision was criticized by Serbia and condemned by the international community.

This was the third time that the Serbian List faced attempts to prevent it from participating in either parliamentary or local elections this year.

The United States Embassy in Pristina said on Facebook on Wednesday that the Vetëvendosje Movement's efforts to block the certification of the Serbian List "are short-sighted and divisive."

The European Union Office in Pristina stressed that "the politicization of the CEC by the Vetevendosje Movement and other political parties is detrimental to the inclusive electoral process."

Jonathan Hargreave, the UK ambassador, said he felt "concerned" about the latest attempt by political actors to prevent the Serbian List from participating in the electoral processes.

“Such actions risk undermining Kosovo’s hard-won reputation as a multi-ethnic democracy and damaging relations with its close partners ,” Hargreaves said on Facebook.

Meanwhile, the German Embassy expressed "regret for the obstructive behavior of some members" of the CEC.

"The electoral process and technical preparations for the elections must be free from political maneuvering by political actors ," she wrote on Facebook.

Even for the parliamentary elections of February 9 and the local elections of October 12, the CEC did not certify the Serbian List. The decision was later overturned by the ECAP./ REL
