The Constitutional Court has repealed 12 laws approved in the parliamentary session held on December 5, 2024. In publishing the decision made this Friday, the Constitutional Court announced that it has repealed the decisions on the adoption of the laws: on Payment Services; against negative phenomena in sports; on the prevention of money laundering and combating the financing of terrorism; on the State Matura Exam; on Social and Affordable Housing; on Accounting, Financial Reporting and Auditing; on Compulsory Health Care Insurance; on the Special Prosecution Office; on the Central Inspectorate of Cultural Heritage; on Financing Water Resources Management; on the Central Inspectorate of the Environment; as well as on the Mediterranean Games.
Meanwhile, the Court has found the Law on Banks, the Law on the Central Inspectorate for Market Supervision, and the Law on the Administrative Court to be in accordance with the Constitution.
The Democratic Party of Kosovo had filed a complaint with the Constitutional Court regarding the procedures followed during the adoption of these laws. On that day, the Assembly had adopted a total of 20 laws. The voting was conducted without the presence of the opposition and avoiding the deadlines set in the Rules of Procedure of the Assembly.
According to the Rules of Procedure, the second reading of a draft law cannot be held earlier than 72 hours from the day of its adoption in principle, except in cases of a state of emergency. However, without declaring any such state of emergency, the deputies of the parliamentary majority approved 13 laws in both readings, while 7 other laws were approved in the second reading. Of these, four were included in the agenda through a motion. These procedural violations have also been highlighted by the Constitutional Court.
The Constitutional Court has also decided to repeal the Law on the State Bureau for the Verification and Confiscation of Unjustified Assets, which was approved in the Assembly in two readings on December 5, 2024.
This law was challenged in the Constitutional Court by the deputies of the Democratic Party of Kosovo, who claimed that the vote was taken in circumvention of procedural deadlines. "With five votes in favor and two against, the Constitutional Court has decided to annul the decisions of the Assembly of December 5, 2024, through which the Law on the State Bureau for Verification and Confiscation of Unjustified Assets was adopted," the Court's decision states.
According to this law, it was envisaged that all public officials in Kosovo could be subject to asset verification if there were doubts about their origin. This law was approved by the Assembly on February 9, 2023, but, like the last time, it was challenged in the Constitutional Court by PDK deputies. After a review that lasted about a year and a half, the law was declared invalid on July 29, 2024.
