To curb the resurgence of illegal constructions, the government adopted a decision in 2020 to confiscate illegal additions.
But, while the Council of Ministers predicted a payment at the market price for these additions, which in Tirana costs several thousand euros per square meter, it turns out that they have been estimated at an average price of 223 euros per square meter.
The Ministry of Finance leaves the responsibility for the low prices to the evaluation experts, washing its hands of the responsibility with which it was charged by the Decision of the Council of Ministers 970-2020.
" The evaluation reports were drawn up by licensed experts and the evaluation of the confiscated objects was done using the methods of evaluation of the object, referring to its actual structure and condition in accordance with the legislation in force ", the ministry replies.
Luan Myrtaj, Civil Engineer, Lecturer at the Faculty of Engineering: This is the law. And you, as a state, issued reference prices. If you trample on these prices, then there is no function. An entity that sells cheaper than the reference price is still taxed at the reference price. Valuation makes sense when the value is greater than the reference price. For example, in one area you have the reference price of 1200 euros per square meter. But in that area, due to the luxurious constructions, the investor sells them for 2000 euros per square meter. You rate when you are above the reference price. The assessor would have a role if we were in a democratic legal state. Either a reference price is set, or a fine is imposed: you will pay a 200 euro fine for this and if you repeat it, you will end up in prison. That way it would be more honest and there would be no need to waste power and paper for the VKM. In a situation beyond ridiculous, he could even rate it with a minus and so the state is forced to give him money.
There are a total of 9 buildings found in violation of the construction permit. In total, the companies are estimated to have to pay around 14.9 million euros for 71,000 square meters without permission in the capital. In the evaluation reports, the experts mainly claim that they could not use another method because the facilities were unfinished and that "they cannot we easily find similar properties on the market".
