President Bajram Begaj has decreed today November 9th as the date for by-elections in the 6 municipalities without mayors, including Tirana, even though Erion Veliaj has filed an appeal with the Court of Justice to oppose his dismissal from office.
Regarding this, lawyer Kreshnik Spahiu said that the elections in Tirana can only be suspended by a decision of the Constitutional Court. He said that the Constitutional Court should come up with a decision to suspend the elections, after accepting Veliaj's appeal.
"I assess the situation as a ping-pong of courts, everyone is a little part of the game. People want to read in black and white, the suspension of elections is a constitutional legal act and can only be done by the Constitutional Court, which should only speak through decisions. And I expected yesterday that the Constitutional Court would suspend the elections and this did not happen. The suspension is a legal act, it must be issued by an institution and that is the Constitutional Court.
"Where the president's mistake is, he should not say which court he should have turned to. This is what the GJK says. To say it is not our competence but its Administrative competence. Those who have seen the decree as dark have put their shoulders to the wall, there is still a green light, if Veliaj turns to the court for a temporary measure to suspend the elections, then the court is obliged to express its opinion on whether or not to accept the suspension as a temporary measure ," he said on the 'Repolitix' show.
