The next hearing at the Special Court against Corruption and Organized Crime for the "Partizani" affair, where the defendants are former Prime Minister Sali Berisha and his son-in-law, Jamarbër Malltezi, has been postponed.
The reason for the postponement of the trial was the absence of Fatmir Bektashi and his defense attorney in the courtroom, which prevented the normal continuation of the session. The trial panel decided to postpone the trial to another date.
This Wednesday's hearing was expected to focus on the testimonies of two former officials of the Ministry of Sports, former Minister Ylli Pango and former Director of Sports, Violeta Shqevi, who have been summoned by SPAK as important witnesses in the case.
The Special Prosecution Office aims to shed light through their testimonies on how the legal changes were undertaken that, according to the indictment, paved the way for the privatization of the former "Partizani" sports complex and the subsequent development of construction projects in that area.
The investigation focuses on the amendment to the sports law in 2008. According to SPAK, initially the law did not allow the privatization or change of destination of sports facilities. Later, after successive legal interventions, the possibility was created for these properties to be privatized by the former owners and used for multi-storey buildings.
The prosecution claims that these changes favored the development process of the territory of the former "Partizani" club, where dozens of towers have been built today. According to the indictment, Jamarbër Malltezi has benefited from this process by millions of euros.
Pango and Shqevi are expected to provide explanations in the next session regarding the procedures followed by the ministry and the role of institutions in the legal changes of the time.
In the "Partizani" file, Sali Berisha is accused of committing the criminal offense of "Passive corruption of high-ranking state officials or local elected officials", committed in collaboration, as provided for in article 260 and 25 of the Criminal Code.
Jamarbër Malltezi, accused of committing the offenses of "Passive corruption of high-ranking state officials or local elected officials", provided for in Article 260 and 25 of the Criminal Code, as well as "Laundering of the proceeds of a criminal offense or criminal activity" committed in collaboration, provided for in Article 287, paragraph two of the Criminal Code;
Fatmir Bektashi, accused of committing the criminal offenses “Active corruption of high-ranking state officials or local elected officials”, provided for by Article 245 of the Criminal Code and “Laundering of the proceeds of a criminal offense or criminal activity” committed in collaboration, provided for by Article 287, second paragraph, of the Criminal Code;
Xhimi Begeja, accused of committing the criminal offense of “Laundering the proceeds of a criminal offense or criminal activity”, committed in collaboration, as provided for by Article 287, paragraph two, of the Criminal Code;
Andia Pustina, accused of committing the criminal offense "Laundering of the proceeds of a criminal offense or criminal activity", committed in collaboration, while exercising a professional activity, provided for by Article 287, paragraph two, of the Criminal Code.
