Rama's attacks, judges warn 'Babloku': You are committing

Prime Minister Edi Rama has repeatedly attacked judges and prosecutors, who he says make decisions that violate the citizen's interest. After the May 11 elections, when a campaign to free up public spaces was launched, Rama targeted a prosecutor in Shkodra regarding construction in the Theth area and then extended his attacks and accusations to judges and prosecutors.

Initially, Rama filed charges against Shkodra prosecutor Elsa Gjeli, then judges Hazbi Balliu, Klarent Demiri, Ligoraq Toshi and most recently Marko Boshku.

After the public lynchings, the Prime Minister has asked justice institutions, such as the Supreme Court and the Supreme Administrative Court, including the ILD and the Ministry of Justice, to take measures against those whom Babloku labels as 'judges and prosecutors without a homeland and the flag of the old justice system'.

There have been strong reactions to Rama's statements, at least from the institutions that are supposed to protect the independence of the judiciary.

But today, the National Association of Judges of the Republic of Albania, through a statement, has escalated the language of the reaction, even warning the Prime Minister that it will face the law. The association warns that Rama's accusations border on criminal offenses.

" The Association guarantees to all judges of the Republic of Albania that it will not tolerate any offensive or humiliating action, performance or comment committed by senior state officials, regardless of the power to which they belong."

This Association will not stop at making statements condemning such behavior or expressing solidarity with the judges, but, as appropriate, will exercise any other legal means.

"Posts and comments like the one made against Judge Marko Boshku are on the verge of a criminal offense and, as such, will be monitored by this Association, deciding on the steps to be taken in each case ," a public statement said.

It comes at a time when the Prime Minister is in Brussels, where he awaits the opening of 4 new chapters in negotiations with the European Union. Despite the fact that even at the meeting of the SP Assembly, Rama declared that he remains the only one who can guarantee the independence of the new judiciary, the Prime Minister has proven that from time to time he targets judges and prosecutors, and even comments on court decisions, although he often says that he has no intention of making such comments.

" The attack on individual judges constitutes an attack on the entire judicial power and this, without a doubt, is not only an attempt to usurp this power but may have consequences in the process of integration into the European Union ," the reaction of the national association of judges states.

Full reaction

The National Association of Judges of the Republic of Albania notes with outrage that once again the head of the Albanian executive, in a completely unprecedented and unacceptable manner, has attacked another judge of the Administrative Court of First Instance of Tirana, Mr. Marko Boshku.

First, the Association expresses its full support to Judge Boshku, as a judge with integrity and a model in his work.

Secondly, it urges the High Judicial Council to take a clearer position in defense of the judiciary as a whole and certain judges in particular.

Third, it calls on all our international partners to unreservedly support the reformed justice system, which is primarily a product of their unstinting assistance, and to make their voices in this regard heard by those who have lost this sense in relation to domestic actors.

Fourthly, it reminds the highest representative of the executive branch that any derogatory statement directed at judges constitutes interference in their activity and that, pursuant to Article 145, point 3, of the Constitution of the Republic of Albania, such an action entails liability under the law.

The attack on individual judges constitutes an attack on the entire judicial power and this, without a doubt, is not only an attempt to usurp this power but may have consequences in the process of integration into the European Union.

The principle of separation of powers is one of the features that distinguishes a state of law from a dictatorial state, and this separation of powers begins with the culture of accepting the existence of spheres of competence that do not belong to it. Attacking another power not only undermines this cornerstone principle of our Constitution but is an expression of a mentality that belongs to another regime. /Pamphlet/
