Almost a year has passed since the death of 3-year-old Brian Spahiu.
It is learned that his parents have asked the prosecutor's office for details about the stage of the investigation, the cause of the child's death and the persons responsible, but they were faced with an answer they did not expect.
In the response of the prosecution body, it is stated that "only the victim of the criminal offense has the right to receive information about the process".
This is an absurd answer, since the 3-year-old has passed away.
"These are rights according to the legal provisions of this code, specifically article 58, point d) only the victim of the criminal offense has and always without violating the principle of investigative secrecy. While the right to request information regarding the reasons for the performance or not of an investigative action by the prosecutor, as you have addressed with some "rhetorical" questions in your request, not even the victim of the criminal offense has the right, as these types of questions violate independence of the prosecutor and his competences in the exercise of criminal prosecution", it is stated in the response of the Prosecutor's Office addressed to the family members of 3-year-old Brian Spahiu.
The forensic examination that was done by IML showed that the cause of the fatal death of the 3-year-old was anesthesia, located in the dental clinic of doctor Roland Xhaxho. But the prosecutor's office of Tirana asked for forensic expertise to be done in Italy, since according to the prosecution body, the first act of expertise was incomplete, the conclusion was incorrect and there were no experts in the field to answer all the questions.
It is also learned that the prosecution only interrogated one doctor at QSUT, while the others who were doctors were not questioned when the 3-year-old was admitted to the pediatrics of QSUT, after he had dental surgery at Roland Xhaxho's clinic. .
