A cleaning worker lost his life last night in a road accident in Peqin, leaving his family with emotional and financial difficulties. His loss means an immediate lack of financial contribution to the family. Few people know, but Albanian legislation, through Law No. 32/2021 and the regulation adopted in the same year, guarantees the right of family members to financial compensation, regardless of the insurance company. Family members can seek compensation without the need for lawyers, recognizing their clearly defined legal rights.
How and what do the victim's family members benefit from?
In this specific case, but also in any case where families lose a member in a road accident, the legal heirs of the deceased worker have the right to file a claim for compensation with the insurance company of the vehicle causing the accident within 2 years of the accident. The claim can be submitted in writing or electronically. The insurance company is obliged to register the claim, provide the family members with the registration number as proof, and provide the official form and list of necessary documents.

Compensation for death from a road accident is calculated according to a clearly defined, fixed, legal formula with no room for interpretation, which takes into account age, family situation, annual income and moral/existential damage to immediate family members. In addition to the calculated amount, a fixed amount of 300,000 lek is added for funeral expenses. In this calculation, the larger the immediate family, the more significant the amount.
Deadlines for processing the request
The insurance company is obliged to review the claim for damages against the person within 90 calendar days from the date of filing and to notify the family of the amount of compensation, if the claim is accepted, as well as of the legal reasons for the rejection, if the claim is rejected.

The tragic case in Peqin is a painful reminder of the consequences of carelessness on the road, but it also highlights an important aspect of the legal protection of citizens through the mandatory insurance system.
The victim's family members not only have a moral right to justice, but also a legal right to financial benefit, which helps ease the burden of losing a working-age relative.
