Four employees of the Korça Municipality have been suspended from their duties and security measures have been assigned to them, at the request of the Korça Prosecutor's Office. The employees, who reviewed the permit requests, are accused of favoring certain entities, illegally calculating the luxury tax, to the detriment of the state's interests. The four arrested are Zhaneta Lubonja, Ermal Germani, Olvas Petro and Soniel Prifti.
"It is suspected that they have illegally favored certain subjects and individuals for the purposes of individual gain, by illegally calculating the infrastructure impact tax for new constructions and luxury complexes in districts 1, 2, 3, 11, 12 of to the city of Korça in a lower amount than it should have been paid, abusing the duty and seriously damaging the legal interests of the state", says the prosecution.
Officials suspended from office:
1. Zhaneta Lubonja, born and resident in Korçë, with the position of Director of the Directorate of Planning and Control of Territorial Development, Korçë Municipality, suspected of committing the criminal offense "Abuse of duty" provided for by Article 248 of the Criminal Code;
2. Ermal Gjermeni, born and resident in Korçë, with the position of Head of the Sector at the Directorate of Planning and Control of Territorial Development, Korçë Municipality, suspected of committing the criminal offense "Abuse of duty" provided for by Article 248 of the Criminal Code .
3. Olvas Petro, born and resident in Korçë, with the duty of Budget specialist, as well as in the capacity of the specialist for the calculation of the infrastructure impact tax, Korçë Municipality, suspected of committing the criminal offense "Abuse of duty" provided by the article 248 of the Criminal Code; and
4. Soniel Prifti, born and resident in Korçë, with the position of Director of the Directorate of Local Taxes and Tariffs, Korçë Municipality, suspected of committing the criminal offense of "Discipline of crime" provided for by Article 300 of the Criminal Code.
Notice of the Prosecution:
At the request of the Korçë Prosecutor's Office, an 'Appearance Obligation' is set and the officials of the Municipality are suspended from duty, they illegally calculated the tax for the constructions and luxury complexes.
Four employees of the Municipality of Korçë, the Directorate of Planning and Control of the Development of the Territory, the Sector of the Control of the Development of the Territory who deal with the review of requests for permits (statements, development permits, construction permits, preliminary declarations, certificates of use) at the Municipality of Korçë, were suspended from duty and a personal security measure was assigned to them "Compulsion to appear before the judicial police" at the request of the Prosecutor's Office at the Court of General Jurisdiction Korçë.
The persons under investigation are suspected of illegally favoring specific subjects and individuals for the purposes of individual gain, illegally calculating the infrastructure impact tax for new constructions and luxury complexes in neighborhoods 1, 2, 3 11 , 12 of the city of Korça in an amount lower than what should have been paid based on the law 107/2014, VKM 408, dated 13.05.2018 or the Decisions of the Municipal Council for the period 2020-2023, abusing the duty and seriously damaging the legitimate interests of the state.
Consequently, on 09.04.2024, the Judicial Police Officers at the Korçë Local Police Directorate executed decision no. 106 reg, dated 03.26.2024, of the Court of First Instance of Korçë General Jurisdiction. The Court of First Instance of the General Jurisdiction of Korçë has decided the appointment of personal security measures: "Compulsion to appear before the judicial police", provided by article 234 of the Code of Criminal Procedure and "Suspension of the exercise of a duty or function public" provided by article 242 of the Criminal Code against citizens under investigation:
Zh. L., born and resident in Korçë, with the position of Director of the Directorate of Planning and Control of Territorial Development, Korçë Municipality, suspected of committing the criminal offense "Abuse of duty" provided for by Article 248 of the Criminal Code;
EG, born and resident in Korçë, with the position of Head of the Sector at the Directorate of Planning and Control of Territorial Development, Korçë Municipality, suspected of committing the criminal offense "Abuse of duty" provided for by Article 248 of the Criminal Code.
OP, born and resident in Korçë, with the duties of Budget specialist, as well as in the capacity of infrastructure impact tax calculation specialist, Korçë Municipality, suspected of committing the criminal offense "Abuse of duty" provided for by Article 248 of the Code Criminal; and
S. P., born and resident in Korçë, with the position of Director of the Directorate of Local Taxes and Tariffs, Korçë Municipality, suspected of committing the criminal offense of "Preventing crime" provided for by Article 300 of the Criminal Code.
