
A court decision by the Berat court has ordered the city's prosecutor's office to conduct additional investigative actions regarding a report filed by residents of the village of Lumas in Kuçovë, regarding illegal works carried out in connection with the construction of a water supply system.
The decision was made by Judge Ardiola Çela, who, during the review of the criminal file with no. 814 registered for "Destruction of property", ordered the Berat prosecutor's office to withdraw the investigative acts, continuing further investigations.
In her decision, the judge ordered the two prosecutors, Denisa Perdja and Aida Yzeiraj, to complete 3 main points, tasks that the judge in the case left to them.
According to the court, within a period of 3 months, Berat prosecutors must question and take statements from all residents of the village of Lumas, who claim that their properties have been damaged, in connection with the implementation of the Waterworks construction project.
The second task that the court assigns to the prosecution is to verify on the ground the claims of the residents of the village of Lumas, by appointing an expert in the field, who must specify whether the project has been implemented according to its approval and whether there are deviations or not.
While the third task left by the Berat court is that the prosecution must determine whether there were removed pipes or excavations that caused damage to the property.
All three of these tasks must now be fulfilled by the Berat prosecution, which since 2021 has opened a criminal file with No. 814 on the charge of "Destruction of property".
The complaint was filed by residents of the village of Lumas, who have expressed dissatisfaction with the form and manner in which this water supply is being built, as it is not only damaging their properties, but also destroying the Sinec River Canyon.
But the Berat prosecution has not fully investigated the complaint of the residents of Lumas, settling only for a response from the Kuçovë municipality and then deciding to ask the court to dismiss the criminal file.
The request to dismiss the case was filed with the court at a time when none of the complaining residents had been questioned by the Berat prosecution.
Given this situation, the Berat court has decided to return the case for reinvestigation, leaving 3 main tasks for the prosecution./ OraNews
